OP was the ID that of A USC? I would advise U get all court docs just

in case, the ID situation is a gray area, but at the interview is when U will

be informed if U need a waiver....U can call Lizz Cannon with the question

she gives one free phone consult.

Don't put in the waiver that your with husband suffers from severe anxiety disorder and literally can not go to sleep without you,because he grew up without you and until he met you I bet that he slept,otherwise he would be dead now.His mother has rheumatoid arthritis ,but you did not mention here that she is in a debilitated state that she needs him here to take her to doctor's appointment,give her medication, help her around the house,if his father is around and he has other siblings in the USA then her healthy problem won't be not enough to have a waiver granted. Find a lawyer to file the waiver,because the reasons you mentioned here are not strong at all.

You do realize that people can develop severe anxiety disorders right? I'm not saying that she'll get a waiver or not based on this, but mental disorders are not always present from birth.

EAP - EAD and AP?

Consular processing would make no difference, Lockbox handles them all. But it would add a lot of time on to the process. 18 months or so in Canada.

I am not sure why it would be 18 months either, was just going by what boiler said. My i-130 was approved and my file is now at NVC.

I was just worried I would not be approved for EAD with the record, but if that is not the case it isn't the end of the world I suppose. I thought after bio metrics I would be hooped.

Has anyone ever been able to explain their case to the IO and manage to get a 'get out of jail free card'?

My husband has not had anxiety his entire life, and we have doctors notes to prove this. He has tried medication and it wasn't the right track for him. What could a lawyer say that we couldn't say ourselves?

Does anyone talk there way out?

What happens if my i-601 gets denied because of the reasoning?

He would have access to Provincial health insurance if he moves with you and applies to be a PR. If he has never have anxiety before I would get that documented by a good psychiatrist. That's probably your only hope using that defence.

Extreme hardship cases are difficult for Canadians to get approved as we are not from a third world country or a country where starting things all over again are difficult.

You seem to think you can talk your way out of a criminal history, it does not work like that.

Still unclear what that history is, it may not be an issue but I doubt it.

A Waiver is actually not that difficult to get IF properly presented. I get the impression you are out of your depth.

The first port of call should be to have at least a consultation with a Lawyer, see link above, and find out what you are dealing with. Make sure you have the details needed so that you can get a proper response. There seems to be several issues, could be more.

Then you can take a view as to what to do next. DIY or use a Lawyer if you need a waiver. Waivers are not for everybody. Needs a lot of research.

He is of First Nations heritage so he is lucky that way.

I just mean that the crimes I committed were years ago, and I stole a nail file. Not a car. Maybe I am looking at the wrong way, but I just think being punished for something I did as a teenager seems rather harsh.

I will consult with a lawyer, but what happens if I do not get approved for an i-601?

Because I am from Canada which is a great country (where I have no criminal record) we have a harder time getting a waiver? And therefore can not immigrate to the US?
