i am going to juarez for my interview here in a couple of weeks. i've finished my i-864 because that's the information i got from some guy at the juarez consulate number. however, i have been checking things out lately and have seen this new form -- i-134. what's that all about? do i use the i-134 or the i-864. heeeelp!

Usually, the I-134 is for the K-1 Visa, and the I-864 for AOS.

But, some Consulates require the I-864 for the K-1 too, so you should use whichever form the Consulate told you to use.

Feb. 22/06... AOS Interview - APPROVED!!!!! (Passport NOT stamped)

Dec. 4/07... I-751 sent to NSC

May 23/08... 10-Yr. PR Card arrives in the mail

June 27/11..... Interview - PASSED!!!

July 12/11..... Oath Ceremony

I like those web pages - one of the better ones for accurately explaining what's needed I think. What I particularly like is that it provides OF-167 for the financial requirements information.

I do not see where the link says that I-864 is needed for fiance(e) visas.

I have yet to come across any definitive information in these forums as to whether or not I-864 is required for K visas but I do know that when my wife received her "packet" the consulate gave her the option to supply either the I-864 or the I-134.....

I have never seen any hard requirement for the I-864 over the I-134 from any consulate page I've visited.

Perhaps this is the root of the confusion. Having the option to supply either doesn't make it a hard requirement but some here probably distort the option for either to mean "requirement".

Have you looked at 9 FAM 40.41 Notes, in particular N4.6-3.b(5), or 9 FAM 41.81 Notes, in particular N4.b?

Some people have said that the FAM provides guidance only, not firm requirements, and they may be correct about that. But the following items in the FAM sound like pretty strong, emphatic guidance to me:

- "If any of the following applicants need an Affidavit of Support to meet the

public charge requirement, they must use the Form I-134, as they are

not authorized to use Form I-864: ... (5) Fiancé(e)s."

- "The Form I-864, Affidavit of Support Under Section 213 A of the Act cannot be required."
