Hello Everyone,

I am panicking, please help me. This is my story.

I petitioned my mom from the Philippines. On my AOS, I put the IRS 1040 Line 37 on my current income, which amount did not meet the required Poverty Guideline, so I had to ask a friend to execute an AOS for my mother. The NVC sent me back a letter saying that I needed to use the IRS 1040 Line 22 - which NOW MET the required Poverty Guideline. So I sent a letter to the NVC to disregard my Co-Sponsor's AOS since my income has now met. When they forwarded the packet to Manila last October, the NVC told me that the case is now closed, and just make a corrected AOS together with the Letter to disregard my Co-Sponsor's AOS direct to the Manila Embassy during my mother's interview.

My mother had her interview today but she forgot to submit the AOS because "no one asked for it" she said.

I think that it doesn't matter to me now if they used my friend's AOS. But somehow they still need the consistent information on my AOS, meaning, my Gross income in the AOS should match with my current income in the IRS 1040 Line 22 information.

My mother went back to the Embassy to submit the AOS but she was told by the guard to just send it through 2Go.

I am worried that if she sent it, it might just confuse the people there?

What should we do?

Was your mom's visa approved? maybe it doesn't matter now because they did not ask for it and esp if they saw your income already met the poverty guideline.

5/23/16 - Online status changed to CASE APPROVE dated 5/18/16

5/23/16 - Received AOS approval letter in the mail

5/23/16 - Online status changed to CARD WAS MAILED TO ME

5/24/16 - Card was picked-up by USPS (online status)

5/26/16 - Green Card on Hand!!! :goofy:

You won't know if there is an issue or not, unless she receives a 221g, which I believe she should have received at the interview had there been a problem. Just keep checking back on the status of the visa until it says issued. If you receive a letter from the embassy requesting the corrected AOS before that, send it in at that point.

Personally, I think she was probably approved, why would they take her passport (to affix the Immigrant Visa into) if she wasn't?

Jan 22, 2015 - Packet 3: Mailed (again via PhilPost!) paper/hard copy delivered to out place here in Manila.

Feb 24 & 25, 2015 - Day 1 & Day 2 of Medical @ SLEC. Immunizations given on Day 2, thankfully

Mar 5, 2015 - USEM Interview Appointment - IR-1 Visa Approved! (CEAC Status updated to ISSUED afternoon of interview day)

Mar 10, 2015 - 3pm - Received SMS saying IV Package ready for pickup at 2GO MoA. Picked up at 5pm. (Shipped/Picked Up/In Hand on 3rd Business Day post interview)

Mar 13, 2015 - CFO Manila - Done

I think so too, if she would have need the new AOS, they would have given her a 221g asking for it, or they would have asked if she had it with her.

Evidence of support is a requirement for the immigrant visa, I am surprised no one said anything at the embassy if you mom did not submit the I-864 and tax return/W-2. You can give them a call (I will post info below) and you can check the CEAC website.
