RFEs...how do I know it's over?

Hello VJers -

I've been searching for about 45 minutes now I cant' seem to find an answer to this simple question: I know that everything with USCIS is a guess game, but is there any way to predict that all information originally submitted suffices the requirements and therefore you will NOT get an RFE? I check my mail and email with fear everyday, hoping not to find the dreaded RFE.

1/8/2007 - Submitted for AOS/EAD

1/12/2007 - NOA

1/15/2007 - Biometrics appt received

1/31/2007 - Biometrics appt.

Case is in MSC currently. Thanks

As far as we know, there is no way to tell until you are informed of one. You'll get an email giving you a heads up that you received an RFE. We sent our AOS/EAD on 12/23/06, has biometrics appointment on 1/18/07, and received an RFE on 1/23/07. I've read it can take much longer to get an RFE. The only way you'll know for sure is once you get an interview, from what I can tell.

You can be as perfect as possible and still get an RFE. It always depends on the person opening your document. The one I had did not like 3 languages on my birth certificate and I had to send another one, only in English. That was totally ridiculous, but we had to do it. Good luck to you.

do they send all the documents in one RFE or do they send seperate RFEs for each proof they want???

I already received 1 RFE and they basically wanted my wife's U.S. birth certificate so i sent it to them and they received it, now is there a chance that they might send me another RFE for something else or they send all they want at once?

There is no guarantee you won't get one. Even people who have sent everything get one because papers get lost or who knows why. RFE's are no worry, a LOT of people have gotten them and been just fine, just send them what they ask for.

There is still a chance, I think there is a chance until you actually get the greencard. Usually though I think they do a search to see what they need and ask for it all at once (our RFE was for multiple items) but there is always that chance they overlooked something they needed. Two RFE's don't seem that common though.

Yeah.. This RFE thing is really annoying! But it's really nothing to be "scared" about...

I received one and they asked me for a lot of things: Proof of citzenship of my co-sponsor (that is my mom-in-law), W2's for both my husband and his mother, and they also asked us to get another employment letters for both, cause they thought the letters we sent didn't have enough information!

The only way for you to know faster what's going on in your case is by checking the site www.uscis.gov, using your case numbers! Or you can also register for them to send updates in your e-mail.

I have a friend who received two RFE's separately... That sucked! In the first one, they asked for the sponsor's W2`s and she sent right away! Then, about 25 days later, they sent another RFE asking for the pay stubs! Isn't that stupid?

I think the only moment we can be sure they won't ask for another RFE is when you check your case status and it shows up that the case has been approved or when they say they sent you a letter with the interview date...

Personally...I think that often the RFE's are often just a way of manipulating the timelines so that "they" are in compliance. Too many people get RFEs for information that was included. I am one of those people that got RFEd for matter that should not have been rfed.

They are supposed to inspect the packet completely to avoid multiple RFE but they do happen.

I have a question....reagrding an Application to Register Permanent Residence/Adjust Status....

Today my husband received in the mail a "Request for Initial Evidence (I-485)". It basically said that they needed my W-2, Federal Income Tax Return, and Evidence of current employment within 87 days. I already sent the employment evidence letter, so I dont understand why they are asking for it again. But the W-2 and Income Tax, I'm guilty of not giving the first time.

Is that all I have to give them???

And...I have another question....

There was also something written there saying "You are ineligible for interim employment authorization pursuant to Title 8, Code of Federal Regulations, Section 103.2(B)(10)(ii) until 90 days after the missing initial evidence is received."

What does that mean? Does that mean my husband will have to wait another 90 days before he can get work here in the US??

I also think it's pretty stupid to get an RFE for a job letter, for instance, when you already supplied your tax return, W2 abd pay stubs, when the instructions form says pay stubs and job letters are optional, so they shouldn't RFE you for it.

Send them exactly what they asked for, even if you've already sent it in once (like the employment letter). I'd be sure you had the letter formatted how they want it (instructions are on the I-864) and also include paystubs as evidence of employment, along with the tax stuff.

It does mean he will have an additional 90 days added, or that his EAD timeclock of 90 days will not start until they have received your evidence. However, it doesn't always take the 90 days so don't worry too much. It didn't take another full 90 days for us, but it is possible. It also means that you can't (well, they don't want you to) call about your EAD being outside of processing times until 90 days after they receive your RFE instead of 90 days after you initially filed.
