i'm a green card holder but soon to bea us citizen, my wife is a us citizen and we want to adopt my 16 year old sister, my question is can we adopt my sister and will she automatically be a us citizen or we have to apply the i130 to petition for her as our adoptive daughter

You can probably adopt her but that doesn't qualify her for immigration. You need to study this subject in depth to decide what is best to do and when to do it. Its far more complicated than you think.

even if she was an orphan, the adoption had to be finalized before her 16th birthday, so even if you could adopt her by your countries laws, you wouldn't be able to file for her for immigration purposes

when you become a USC you can file for her as your sibling, it would be over 18 years of waiting, but that would be the only option on your part.

She's too old. And you would have to wait 2 years to fulfill the legal and physical custody requirements (meaning she would have to physically live with you) before you could file I-130 for her anyway.

Then there would have been large number of family adoptions for immigration purposes.. it's not so easy, is she an orphan?? She's near adulthood and 16 is just too old.

You mean to say in Mexico people cant be adopted that are over 16 years old?

Mexican laws are different than US laws, and US laws for immigration purposes are different. For US immigration purposes he would have had to adopted her prior to her being 16 plus a lot of other rules. He can adopt her in Mexico and she would be his daughter (if Mexican law allows) but she would not be eligible to immigrate to the US under the immediate relative rules.

the reason adoption has to be filed before 16th birthday for immigration purposes is because the process takes time and the beneficiary would be over the age of 18 by that time.

nope, US general immigration rules to petition adopted children, in order to file a petition for adopted children, the adoption had to take place before he or she was 16

while in the foreign countries the adoption can be legal, you would not be able to bring her through immigration process because she is too old as the others have said

Timeline

It is too late for your sister to be adopted by anyone and have it help her immigrate to the US. The US looks very closely at near relative adoptions because a lot of people try to use them to avoid the legal paths to bring the same relative adoption. There are also all sorts of rumors that it is easy when it is just the opposite. You will have to file a sibling petition and wait the 18 years.

This will not be over quickly. You will not enjoy this.
