NVC Filers - November 2014

Our scan date was Sep 22nd just called NVC and apparently we're checklisted for corrections on our AOS. Sections 6 and 10 they said (no idea what they are). Was too angry to ask questions but can anyone give me any idea how long it will take from submission of corrections to CC?

I don't see anything in the I-864 instructions about a minimum amount of time for savings, so you should be okay.

My two cents by the way: you're cutting it REAL close to the poverty line. Even with your savings, you'd only be at 26,767, which is just $2000 over the limit. You may be asked to find a different sponsor, either at NVC or at the consulate/embassy (who has final say).

thanks so much Saylin, also can I use 2014 earnings? I don't want to wait until I get my tax refund to send in i864 will my 1040, w-2 and 6 months pay stubs and employment letter and bank statements be okay.. Or do they prefer tax transcript.?

I'm sorry :( I know how it feels, 60 days for everything now days with nvc, I did also get a checklist for aos back on 10/1 and till now still waiting to get review... 47 days and counting :(

Being that the new job won't start until September, it's not going to affect the AOS paperwork (unless you're still stuck in this process till then, which let's hope not!!) So, you don't need to do anything :no:

Yeah it's a huge relief and it's the kind of job he really enjoys (law clerking) so he is stoked.

Stupid AOS fee still says "PAID"... sigh...

I'm seriously confused because they're telling me the problem is the total income on part 6 10 and 13a1 but we only used my wifes income and our attorney filled the form out? How on earth could that be input incorrectly?

Yep same issue the ol 13.a problem, thats exactly what my checklist was and it was also filled out by my attorney.. Trust me if I would off found this site before she fill out the papers I would off avoid a checklist. lots of problems with the same aos part a lot of people getting checklist for that.. Im so sorry :( I know how frustrated you must feel I cry for days and breaking the news to my hubby was horrible.. all I can advise is to have your attorney fixed it and resend it asap

Yeah. What baffles me is that NVC clearly know where the error lies and what the correct amount should be, they can't just correct it themselves :( ? Made the mistake of sending an incredibly strong worded email to our attorney, so here's to hoping he doesn't cancel our contract!

Yeah its ridiculous that something so small will cause you 60 more days of delay and is something clearly we could fix and take to the interview but I guess there is a reason they work that way.. Oh trust me I when off at my attorney, I was furious that I wasted $3000 to make sure nothing was wrong and get through this faster and this happen but not only that 13 a part was wrong she had left the total sponsoring question blank as well. The main attorney at the firm call me and told me I was beating up her staff oh I got even more angry then. she fixed it the same day and resend it via fedex it got there on 10/3. To be honest I'm still scare that something is wrong and terrified of another checklist for the same aos...

I'm not sure what you mean exactly by can you use your 2014 earnings? On the question asking for the past three year's tax information, you can't use 2014 yet as the year isn't over. But, you can put your current salary in the question for current annual individual income. NVC looks at both CURRENT income as well as the most RECENT tax year (currently being 2013). Keep in mind though, the consulate/embassy can look at whatever number(s) they want and if they don't like it, they can request a joint sponsor.

And as it states in my wiki, NVC prefers tax transcripts. Why? For starters, most transcripts are only a couple pages. Compared to a whole heck of a lot when it comes to tax returns. Cause you don't just send the 1040 and W2, you also need to send the 1099s, schedules, worksheets, etc. Basically everything sent to the IRS has to be sent to NVC. Plus, a tax transcript is proof you actually filed taxes. Anyone can fill out a 1040. Doesn't mean at all that it was sent to the IRS. And unless you live abroad or are in a special situation, there's absolutely no reason to not get a tax transcript. They are provided FREE and can be obtained instantly online. And if you don't have a printer, they can be mailed within a week or two.

I'm still waiting for case number from NVC and I didn't make that much in 2013 due to being in school so if for say I paid both AOS and IV fee by January or February can I use 2014 income as recent..? Or do I HAVE to use 2013 income because I sent the AOS before the tax deadline in April..? Sorry if I'm confusing or a pain, just trying to get a clear understanding of it.. Edited by EmpressJA

Hello fellow Vjers,

our case got completed finally!!! Our last scan date was september 8th and 9th for IV and AOS checklist. I have to appreciate all VJers that helped me get through this madness. I posted last week about our problem that NVC omitted our case and had not reviewed it till this week's monday which is far over 60days torture.

I called several times and on hold over 1 hrs to talk to a supervisor, and after talking to a supervisor our case suddenly got completed a few hours later that it feels like it's almost a miracle. I and my husband were even talking about we might even name our future son after the supervisor that I talked to. Now I wish i could get december interview and spend Christmas and new year with my husband.

I wish all VJers the best luck and swife case closure.

From January (when you get your W2s) up until April 15th (tax deadline), you can use either 2013 or 2014 as the most recent tax year. But remember, even if you wait that long, a joint sponsor can still be asked from you if you were below in previous years.

what's the error here? Do they expect numbers in Part 6 item 10 and 13.a.1 to match ? Do you know what the correct amount should be ?
