So you were in AP before filing the waiver? Did you have to provide proof that he was exonerated when you initially filed? I can't remember the wording on the questions you must answer about prior issues. Didn't he have to provide police reports to the embassy before or at his interview?

We were in AP for over a year. We just filed the waiver this August.

Yes, they knew about this, it was on the visa application. The police report was clean even though we told them he had the case. At the interview they didn't ask him any questions about it at all. It wasn't until after we told them about the phone call for the bribe they called him back in and asked him questions about the case.

My biggest issue with the Embassy. There's no reason a couple should be in AP for this long. 6 months is a stretch as it is.

When they limit your ability to fight against them of course they can. They can do whatever they want. No one has the power to control them.

No. I was told $20,000. That ain't happening right now. If all else fails we will wait until I am able to move back to Sri Lanka.

Basically, it says USCs nor foreigners are able to take the U.S. embassies to court to sort out issues with denials or other problems. Courts don't have jurisdiction.

The can however ask the embassies to make a decision on an application that has been pending for a while but they will not litigate when it comes to matters of the embassies' decisions.

Even if it involves giving out confidential information about an applicant.

At 50+ pages PDF This matter is perhaps too complicated for a layman to rebut this decision. A person that understands the laws of the country involved and immigration law is needed . One that has been successful in arguing this type of case, That type of lawyer perhaps would be hard to find.

So you submitted a clean police report when you filed. You were in AP for over a year, was this before or after the interview, again I don't know much about how things work with AP. When was the bribe mentioned to the Embassy and when did the local police ask for it?

Consulates handle Visa's but they do not handle AP. That is a collection of different Government Agencies.

Mandamus just gets the Government to do something, which may or may not be to your liking.

AP can take a long time, no experience of Sri Lanka, well I have been there, but if you look at Pakistan year plus is not unknown.

Yes, we gave an unsealed police report to the U.S. embassy. The U.S. embassy I guess didn't understand why it was clean after we disclosed the information on the visa application so they sent a letter to the Police Station to confirm my husband had no problems. He was put in AP after his June 2013 interview. We didn't know what was happening during the AP. Then, the police officer who worked my husband's old case called him and asked for a bribe to send back a letter to the embassy to tell them there was no problem. We said no. then I contacted the embassy to tell them what happened. This was July of last year.

Consulates handle Visa's but they do not handle AP. That is a collection of different Government Agencies.

There is consulate level AP and U.S. government level AP for terrorist ties and previous stays in the U.S. My husband was on consulate level AP or Administrative Review what they sometimes call it.

Making enquiries in Sri Lanka is probably not quick or easy.

It's not quick or easy but they are the ones who are supposed to find efficient ways of handling these situations.

Again, they were not able to disclose information pertaining to a visa application. To tell the local police we knew about the letter they sent to the police and we told the embassy about the bribe is against the State Department's rules on visa applications.

They could have does so discretely.

It sounds to me like the problem is with the local police. They aren't providing the info the Embassy needs to advance your case. If they sent the Embassy a police report saying your husband is being charged with the crime, it's out of the hands of the Embassy, IMO. Unless I'm not understanding it correctly.

If they sent the Embassy a police report saying your husband is being charged with the crime, it's out of the hands of the Embassy, IMO. Unless I'm not understanding it correctly.

Its too much information. That's why I didn't post about my problem.

We told the embassy there was a problem.

Police cert said there was no problem.

Embassy contacted police to ask if there was a problem.

Police contacted us for a bribe.

We told embassy

Embassy told police we told them.

Police got mad.

Recharged my husband with crime even though he was exonerated.

found inadmissible. (we knew this cause he plead guilty) but they also slapped us with mis rep but never told us what we misrep. We told them everything from the beginning. They knew all along.

1. problem. if you go to the embassy with something in confidentiality they should not be able to give out that confidential information. Just like they can't for refugees. If I tell you someone is trying to get a bribe from us or black mail us, why would you tell that person we told you? they know the government over there is corrupt and has a reputation for killing their citizens.

If someone entered illegally and married a USC while here, the law allows for a waiver in some cases and there is a process for that, just like everything else. Some of the people at that site fall into that category.

If someone is here illegally, they should be deported or go back home before USICS will even talk to them period .

Telling the embassy the local Po Po was corrupt was a bad move, because they have no control over them, but have to accept whatever they tell them. I would suggest doubling up that bribe and kissing some police butt

It's like arguing with my wife sometimes. Do I want to be right or do I want to be happy , over something small

Too late now. But if we did give them the bribe and the embassy found out later, what would have happened to us? He still wouldn't have gotten a visa. Again, information pertaining to visa applicants are supposed to be confidential.

This is not a simple RFE . A lawyer needed to be involved . There are mine fields that we as laymen have not a clue.how to handle. As things are in motion you will need to roll with your decision. As I have said in the past ... We folks on this forum jump through hoops to accomplish what is needed..
