Ok, so we have been married since September and are FINALLY sending the AOS in next week. But I am confused about a couple of things:

I was told that she can't get a SSN card until she has her EAD, is this true? Or can we go in now and get one?

When are we able to official change her last name?

it depends, some people have just taken their passports and marriage certificate to the social security office and where able to get one, and other where required to have the EAD before they would given one. i guess it really varied from one office to another.

as for changing her last name, this can be done when u are applying for a SSN, they would need to see the marriage certificate for that.

K1s can apply for SSN as soon as they arrive to the US, however, I believe if her K1 is expired she'll have to wait now until she's got the EAD. AFAIK, they won't issue a SSN to someone with a K1 that is near 2 weeks to expire, or has already expired.

Technically she is not eligible for one since her I-94 is now expired and she will have to wait for her EAD.

I see now, thanks. So we'll need to wait for her EAD now because her K1 is expired even though we are already married.

Did you file her AOS papers in her new name?? doing that will ensure that her EAD and her greencard are in her married name and not her maiden name....

Yes thank goodness. I had a lady at the county building here tell me that after we were married we didn't have to do anything to change her last name and that it would automatically (magically I guess) change...theat didn't sound right to me and I almost filed them under her maiden name!

Lol, it didn't magically change for me! Then again I'm the USC so I dunno how that affects things. Legally she has your name now but you'll still have to change it on stuff like insurance, SS card (if she did have one), passport, and anything else where shes got her old name.
