Police Clearance Question

Hi, all,

I've been asked a question I'm not sure how to answer.

For someone that arrived on VWP that is going to remain in the US and is now submitting the I-130/I-485 (within the original 90 days of arrival) is a Police Clearance required? I always thought they were (but David and Chris were K-1/K-2 so wasn't the same situation) but in reading the I-485 it states:

"If you are filing for adjustment of status as a member of a special class described in an I-485 supplement form, please read the instructions on the supplement form to see if you need to obtain and submit police clearances, in addition to the required fingerprints, with your application."

From reading all the supplement forms I do not see that they apply to her situation so is it correct that the Police Clearance isn't required? Am I missing something?

Can anyone that entered on the VWP and submitted the I-130/I-485 shed any light on the situation? :help:

I adjusted from F-1, and I didn't need police clearance. I'm sure A VWP won't need it either.

No PC is required or even asked for. The biggest problem will be showing non immigrant intent and that visa fraud was not committed.
