Filing for AOS, Patronymic name on Marriage License

Hello. I am the USC petitioner. We just got married and were about to send our I-485 as soon as we got our marriage certificate in the mail. Here is the story.

My fiancee is from Lithuania and her birth certificate is in Russian/Lithuanian. The birth certificate lists her first and last name but also lists her patronymic name which is her fathers first name. She does not have a middle name and has never used one. Her Lithuanian passport, all the K-1 visa documents/application, and the K-1 visa itself lists her name as it should be- just her first and last name with no middle name. We got the marriage cert in the mail yesterday and what happened is they used her patronymic name as a middle name. So now she has a first name, middle name (patronymic - her dads first name) and last name (which has been changed to my last name). We went to the town office where we got the marriage license and they didn't really understand what a patronymic name was and that my fiancee has no middle name- even though no middle name appears on her passport of visa. After some time explaining they gave us a form to send to New York state to request a change on the marriage cert. There was a section to explain the reason for the change and I wrote that the middle name put on our marriage license is not a middle name and that it is a patronymic name not used by my fiance. We asked that it be removed and also included a copy of her passport for proof. The lady did say it is up to them wether or not they allow it because it lists her patronymic name on the birth certificate. She also told us it would take about a month to hear back from them.

My question is now that we have to send the I-485 with a copy of the marriage cert will it matter that they put her patronymic name as her middle name? As I said so far we have done all paperwork with only a first and last name for her. We have filled out the I-485 with only her first name and her last name, which she has taken from me so we now have the same last name. I just don't want her to get a EAD or greencard with her fathers first name as her middle name. I also dont want to wait a month to file aos when we don't even know if New York state will even agree to remove the middle name on the cert.

Hi!

When you file for AOS the name you write in the forme will be the one appearing on the EAD/AP/GC and documents.

My marriage certifícate doesnt even show my new last name here ar expedite with your maiden name.

So we just filed the forms with my husband's last name.

Some forms will ask about previous names or other names used , you can write there her maiden last name and maybe even the one on the marriage????? Attach a paper in the back of the page explaining what's going on

Even lots of women remove their middle name ( I know it's not her real middle name ) and there is no problem.

Just make sure to file the forms with the name she wants to have

The name you filled in is the name that will be on her green card and EAD: Her first name and your last name, no middle name. It won't matter what her names were prior to this, only what you choose as her given name. That is what the space for previous names is for. They will see that her names on her k1 visa and passport all have only 2 names and the new change is only to your last name. When your NOA comes, it will be addressed in her new name.

Hi, what's the update? Did your wife have a problem with the USCIS when you filed the AOS?
