The Expiration date of my IR-1 Visa is Nov.20,2014

Hi Everyone,

I need your help and personal experience please. Here is my situation I got my IR-1 in hand the expiration date is November 20,2014 unfortunately I can't travel to America before then because of unfinish Business here in the Philippines to taking care of. my lawyer said visa extension is not an option because it is very difficult to do, so my plan is fly to America Nov.15,2014 and turn around after 5days without my green card? is that possible? I'm planning to move to America for good in December 2014 after I taking care the unfinish business here in the Philippines.,,,,maybe flying out from America to PH is not a problem but how about re-entry in America in Dec.2014 without green card in hand?the stamp of my passport at the POE is enough to re-entry? Please guys help me what can I do to re-entry in America in December2014? I'm so worried if the POE immigration officer grill me.,,,I heard that after arrival in America I have to wait for few months for my real green card? I can't wait that long I have to come back here in PH right away. we already PAID my green card production fee last August 2, 2014....Thanks and please share your personal experience if you have any, idea,opinion,suggestions is welcome.

11/17/1998- Received first love letter from Bob (my husband now) we wrote love letters back and forth for almost 2years.

09/2/2000- First meeting in person.

09/26/2000- We got married.

01/2/2001- We both left for South Korea working at public school as an English Teacher.

08/20/2005- I came home to pursue my University Degree in Business at University of San Carlos Cebu City Philippines (USC)

10/25/2009- Got my Degree.

10/26/2009- Went back to South Korea working again.

06/12/2012- Bob officially retired.

06/14/2012- Bye bye South Korea, Welcome home Philippines.

06/22/2012- Bob and I officially owns our houses and lot in the Philippines.

08/24/2013- Sent spouse petition to USCIS.

09/26/2013- USPS notify us that our package has been received by the USCIS.

09/13/2013- Received NOA1 hard copy from USCIS.

09/13/2013- Patiently waiting for our NOA2.

12/3/ 2013 -transfered to NVC from USCIS

1/17/2014 - still no news from NVC

3/8/2014- NVC Invoice arrived paid the same day:)

Yes being you are IR-1 you can do that. I read of others getting their card within a few weeks of arriving and the fee paid. If you card does not arrive quick enough you could contact USCIS about travel until it arrives, there has to be options available.

Hi Hank thank you very much for your quick reply. So meaning I can't re-entry in America in December without my real green card? so maybe next day after my arrival in America I will start calling USCIS to ask my green card?:) Do you have contact number in USCIS that I can talk to a real person? Thanks again.

Virgo girl, just for reference how long ago was your IR-1 visa issued? In other words how long is it valid for? From what date upto Nov 15th?

Jan 13, 2015 - MNL Case Number & Packet 3 Received via email (I emailed the IV Unit-Manila requesting these on Jan 5, 2015 and Jan 12, 2015)

Jan 21, 2015 - NOA2: Mailed (via PhilPost!) paper/hard copy delivered to our place here in Manila.

Jan 22, 2015 - Packet 3: Mailed (again via PhilPost!) paper/hard copy delivered to out place here in Manila.

Feb 24 & 25, 2015 - Day 1 & Day 2 of Medical @ SLEC. Immunizations given on Day 2, thankfully

Mar 5, 2015 - USEM Interview Appointment - IR-1 Visa Approved! (CEAC Status updated to ISSUED afternoon of interview day)

Mar 10, 2015 - 3pm - Received SMS saying IV Package ready for pickup at 2GO MoA. Picked up at 5pm. (Shipped/Picked Up/In Hand on 3rd Business Day post interview)

Mar 13, 2015 - CFO Manila - Done

Now disposing/selling/giving away/shipping to the US stuff from 14 years in the PHL and 4 years together before heading to POE.

Your I-551 stamp you'll get in your passport is good for re-entry into the USA. You shouldn't have any issue re-entering the country. What I would worry about is Philippine Authorities or the Airline realizing you can enter the USA with that stamp.

The expiration of my visa is November 20, 2014 dead in dead meat lol...I got it June but my medical is before June 2 so just figure.

Nothing a few pesos won't solve, st least with Philippine immigration officers. :lol:

I would contact the airline about travelling with the I-551 stamp. Hopefully you can get an official letter or page from their web site explaining the I-551 stamp is legit to travel into the USA. Then carry it with you when you leave the Philippines on your return trip to the USA.

Just in case, have a power of attorney written up and notarized here locally and designate someone you trust without hesitation. That person can legally stand on your behalf on all matters from legal standpoint, so they can help you wrap things up for you in case you get delayed coming back here sa Pinas

Not exactly, what I am suggesting is it is possible to get a document for re-entry if you green card hasn't arrived, I would suggest calling the local USCIS office in your (your husband's) area. I read something along this line some time back which is why I believe there is a solution available.

Folk have probably already answered you, but here I go ;)

study the visa foil inside of your passport, search for the line that says 'endorsement'

and then know:

1. endorsement occurs at POE

2. I-551 is another label for green card

then

let us know your thoughts?

She not need to chase after any document or stamp at a USCIS office after arrival, Hank_ ,

as

being an IR-1 visa holder,

she gets a stamp at the POE, that turns her visa into a temporary 1 year green card, an I-551 document. She could turn around same day, after exiting POE, and get on another plane back to the PI, and be allowed multiple entries into the USA, up to one year, based on that endorsement stamp at the POE.

It's sweet, but K-1 visa chasers don't get this, at all.
