EAD not received in 90 days

Good Afternoon,

I am waiting for my EAD card to be approved. Today was the 81st day. I applied on August 8th, after I got married along with I-485. The 90 days due date will be on Nov. 7th. I didn't receive any REF or Intention to Denied letters. I called USCIS yesterday, and I requested expedite service for my I-765 because it passed more than 75 days. The person I talked with told me that there are specific reasons for which to request expedite service( which I am aware of) but I was not sure if I would qualify for any of them. He said that will place a request service, NOT expedite request for my I-765 application, and in 30 days I should hear from them via e-mail regarding the status of my application.

I do have a job offer. Actually it's the same job I had until September 30 when my H1B visa expired. The employer could not extend my work visa but knowing I was in the AOS process, I've been told that they will keep my job until I'll receive my work authorization card, and I'll be able to work again. Now it is almost the end of the month, and I did not receive the EAD. I am not sure if a job offer letter would be enough to request expedite service, and if such a service is appropriate knowing that is getting close to 90 days timeline.

Also reading other posts, someone stated that an expedite request is not allowed if didn't hear from them yet regarding the previous service request, and I should wait 30 days..:(

I am wondering which should be the next action step to take if the EAD will not be approved in 90 days? Should I mail/Fax the job offer letter ? Is the interim EAD an option ? We live 3 hours away of the closest USCIS office, and scheduling an INFOPASS may be difficult. Did anyone experience something like

this ? I would really appreciate some advice.

Thank you so much.

hi

you should have requested an expedite with your job offer letter. From what im reading on the forums, they will likely approve your request if you have a job offer.
