Visiting your loved one while awaiting K1 visa

When my fiance and I started to investigate the K1 visa process I went to see an immigration lawyer (that free consultation). When I asked about visiting Scott in California while waiting for the K1 visa, she told me that under no circumstances could I cross into the United States. WHAT A LOAD OF BUNK!

Because we were afraid that it would take a long time to get approval, my daughter and I flew out the CA for the month of August so she and her daddy could get reacquainted before the dreaded separation. When we crossing the boarder we were asked where we were going, why etc and I was honest "going to see my boyfriend" and they asked if he was Bella's dad. I said yes and for a minute thought "Oh #######--I'm not going anywhere". The Customs agent asked if I was aware that we needed a visa to stay in the US and I explained that because we were going to send in the application soon and were not allowed to travel to the US afterward we were going now. It was then that I was told that WE CAN TRAVEL TO THE US WHILE AWAITING THE K1 AS LONG AS WE CAN PROVE THAT THERE ARE TIES TO CANADA. Of course, I have a job here and 2 older children so he said there would be no problem! We are so relieved and can only imagine how many other people were told that they would have to be separated during the wait or can only travel one way. (He doesn't have the flexibility that I have to travel as he has a full time job and I am on Maternity Leave).

What have I learned? 1. don't believe everything a lawyer says

2. sometimes it pays to talk to the Customs/Border agents--they can be nice sometimes

3. read postings here because I have noticed many others visiting each other during the long wait!!

yeay VJ!!!

Filed: K-1 Visa Country: Philippines
Timeline

Hello,

Maria and I have traded a number of visits from/to Philippines. Her multi-entry tourist visa has been sufficient and her current ties of children and job in Manila pose no problems to visit - BUT there is always the possibility of some border official thinking of problems if you have no information to support a K-1 (or future K-1) applicant returning home as expected.

P.S. in my years of dealings with lawyers I find 10 lawyers=10 opinions=10x10 preceived problems
