RFE for paper size? Unless the lawyer printed on 8x14 paper, all of the searches I did on this question seem to suggest that USCIS doesn't care about A4 vs. 8.5x11 paper. If I were you, I'd demand to see the actual RFE.

OK, finally received the denial letter. They listed two reasons for denial. 1-petitioner (that's me) passport picture missing. 2- petitioner signature missing. Yes, it was my mistake but, I fedexed everything to my lawyer. He never warned me about these things missing.

Anyway, they are asking us to fill out I-290B and $630.00 fee (which our lawyer will pay)

Thanks,

Eddie

Best of luck to you! It is nice that the lawyer will eat the bill for the additional paperwork, it was something he was paid to check afterall. I also hired a lawyer, if anything for a piece of mind that they would check over everything to keep this sort of thing from happening. I assume that the reopening of the case using the I290B will be much faster than starting over. Again, best of luck for a speedy approval!

I'd dump this lawyer for any future work, and frankly unless you have some really complicated problems you don't really need one. What also troubles me is what they originally told you about the RFE, which seems to be complete nonsense.

I wouldn't do I-290B - you messed up, not USCIS fault, they rightfully denied.

File a new I-129f and this time make sure you get everything correct from the get-go. VJ has excellent guides, spend some time reading them.

Hello guys,

After k-1 denial, our lawyer is insisting that re-filing K-1 fiancé visa has a better chance to get faster approval (NOA2).

We were planing to get married in my fiancées home country and reapply for K-3 marriage visa. Now, we are confused. Any advise would be greatly appreciated.

Thank you in advance, and good luck to all of us

Right now the I-129Fs are going faster. Because you were denied because of a filing mistake rather than later at the K1 interview, it makes sense to just try again for a I-129F/K1.

Personal opinion, of course. Make sure your paperwork is properly filled out this time.

I have a doubt about this case: If they sent you a RFE in september for the paper issue why they didn't request the missing documents (Pictures and Signature)? I definitely don't know if they don't request documents like these in the RFE and just deny right away! I have seen people saying they forgot to include letters of intent and even the G135A and they got RFE for that! I am confused!

I wish I could include the copy of RFE here. It wasn't clear at all. On the denial letter they spelled it out missing passport pictures, missing signature of petitioner (that's me) on g325a
