Help needed please. No idea where to start..

Timeline

I believe DCF would require her living in your country with you.

August 2000: We start e-mailing. I'm in Bosnia, she's in Florida

October 29th 2000: She sends me e-mail asking if I would marry her

October 29th 2000(5 seconds later): I say yes

November 2000: She sends me tickets to Orlando for when I get back

December 6th 2000: Return from Bos

December 11th 2000: Fly to Orlando, she meets me at airport

December 22nd 2000: I fly back to UK

January 3rd 2001: She flies to UK (Good times)

Mid February 2001: Pregnancy test Positive

Mid February 2001: She flies back to US

March 2001: Miscarriage, I fly to US on first flight I can get

May 2001: I leave US before my 90 days are up

June 2001: I fly back to US, stopped at airport for questioning as I had only just left

September 2001: Pregnancy test Positive again

September 2001: She falls sick, I make decision to stay to look after her as I am afraid I may have problems getting back in.

April 16th 2002: Our son is born, we start getting stuff together for his passport

March 6th 2003: We leave US for UK as family

Early April 2003: Family troubles make her return to US, I ask Embassy in London about possibilities of returning to US

April 16th 2003: London Embassy informs me that I will be banned from the Visa Waiver Program for 10 years, my little boys first birthday

June 13th 2006: I-129f sent

August 11th 2006: NOA1 Recieved

After our relationship breaks down she admits to me that she had never bothered to start the application process

It sounds like a ###### headache to get a working visa. What I think is not to worry about working in the US next year, and just work on getting a Green Card so as soon as possible so in the future I can come over and work. Getting over there next year isn't vital, but obtaining a green card ASAP is.

Does anybody here know what effects becoming an independent has on my college student girlfriend?

Migrating to the US is a f'n headache, period. That's something you'll need to get used to the idea of no matter what, and the girl had better be worth it (as had you) ;)

The latter is probably outside the scope of this forum; you might get lucky, but I doubt it.

Catherine would be coming over here if we wanted DCF. :)

After talking to Catherine it looks like our best option for us is this. Marry after college in Australia. Have her live here for at least the minimum 6 month period and apply for DCF after that time is up, then come back to the USA after I get the green card. If I happen to get a Work Visa next year that would be great, but if not I'll visit her on VWP and just wait it out for her. She's absolutely worth waiting for. <3 :)

I better start looking up the DCF process. Any advice or tips?

Any advice on the possible working visa for next year...I'm still confused as to what I would be applying for there?

Also I saw something called the Student Work and Travel Pilot program..could that work for me maybe to work next year?

Current DCF procedures state that if a US Citizen lives overseas they may file the I-130 for a foreign spouse, child or parent at the US Consulate / USCIS Field Office governing their place of residence.

This is from the FAQ here. I should be able to apply at the US Consulate in Sydney?

The FAQ you reference has not yet been updated. At the start of 2012, a new procedure was implemented that ended filing at Embassies and Consulates unless there was a USCIS field office in the country. Lately, petitions filed by petitioners who live abroad and DCF is not available appear to have their petitions automatically expedited if the petition ends up at the service center in California. USCIS will officially deny they do this but reports from other members show that it does happen. There is no guarantee the petition your spouse will file will be automatically expedited.

You will interview for a visa at the US Consulate in Sydney; however, you will not be doing that until the petition your spouse files is approved and other steps between petition approval and interview are complete.

There is a whole alphabet of visa's. Each withe different requirements. Being offered sponsorship suggests they have one in mind.

Yes; stop posting personal information unnecessarily.

So far we've got your first name, last name, age, occupation and locale, and from that it's not far to your employment/school history, then straight to your facebook.

While that's not necessarily a problem, it's not smart, especially when you're dealing with USCIS; an agency who has no vested interest in getting you into the US.
