Question about filing k-1, previous failed marriages

In 2002 I filed a K-1 visa for woman and was succesful but it sadly ended in divorce 3 years later.I filed a succesful CR-1 in 2011 and she arrived here ok but sadly that ended in divorce as well in september this year. She moved back to China but has her 10 year card and can do as she pleases, she may come back to the states in the future.

I just returned from Philippines on holiday, met a woman purely by chance and we seem to hit it off right away.

I will return to see her again in january or so.

If I apply for a fiance visa for her, will i have much trouble? We thought K-1 might be easier. I know will be under scrutiny but life happens.

Thanks for any advice in advance.

Craig

Bringing a third person and getting them a greencard will definitely be a red flag, yes, and considering it is happening so quickly after the divorce from wife 2.

The best thing you can do to increase your chances of approval is lots of face time- ie visit 2-3 times more before filing, if you have kids, make sure they meet her in person too and take photos etc.

Thanks for the advice,Yes I know is very soon after divorce, but life happens. I never intended to meet anyone while I am on vacation. Was attending a friends funeral and happen to meet her, we exchanged e-mails and spent a couple of days together in Manilla a week after the funeral. I plan to fly back at least twice before we file for a K-1.

My ex moved back to China, hates Minnesota and me, cannot help that.

Thanks for everything.

Hey,

The K1 Visa requires a 2-years relationship at least and I was wondering how would you prove that you have been with this person if you just divorced? I know things happens, however I honestly think they wouldn't approve your case (I hope I am wrong tho).

If I were in your shoes maybe I will try to make this relationship more solid and then apply (She can visit you on a tourist visa for now and stay as much as she can on it)!

Anyways, good luck!

Please don't give out wrong information.

A K1 does not require a 2 year relationship, the requirement is that you have to have met WITHIN the last two years.

You could only have been together for a couple of months and be approved.

No one can say that this new relationship you are not in isn't real, the problem is that this will be your third time bringing someone to the USA.

This has a lot of red flags.

You are going to probably have a hard time with this one IF you do decide to marry this person too.

My advice on the relationship side is spend a lot more time with this person. REALLY know that you want to marry them and go through this again.

Way too many people are under the assumption that spending a short amount of time with someone makes you an expert in what they are like for a longer period of time. People arent the same when it's not a holiday anymore. this isn't always a bad thing, but because this is number three, you really should find out more.

If you eventually decide after spending some time together that you want to do this, save EVERYTHING.

take a lot of pictures with family, friends etc.

Pictures in front of famous landmarks.

Boarding passes, tickets etc etc.

And always be honest about your previous relationships, hide nothing.

Cody and Daisy,

It is not an intentional wrong info and maybe it was just a quick answer, you're right, they DO require to have met within two years and it doesn't mean being on a relationship (WHICH is NOT the case of the the person who created this forum since he just met the person, if I am not mistaken).

By the way, please take this opportunity to give your advice as required by Craig. I assume you're much more experienced than me in this process since you nicely corrected my info, however did not reply to this forum! :)

Have a great one and thanks for the correction!

Dosnt matter if they just met. The only requirement is having met within the past two years. They could have met once and only known each other for a month and it still can be approved.

I did reply. See below my original post to you. Edited by Cody and Daisy

I don't see any issues especially if your doing a K1 in Philippines.

Just as long as your are free to marry is all that matters.

You may have to do a General Waiver which is very simple letter.

I just had a Interview in Manila last week, It was my 3rd K1 to file. Interviewer never brought up anything regarding my prior K1's

Do I need to apply for a General Waiver even though my first application was K-1 in 2002 and second one was CR-! in 2011? Where do I find information on this waiver? I had read somewhere that said need a waiver after already apply 2 previous K-1s but does the CR-1 count as a K-1 application?

Thanks for the help.

I know will be lots of red flags, also I plan to visit at least twice more before even think about file K-1 even if is only 1 week at a time for now, any time together is better than no time.

Thanks

Craig
