We received our NOA2 and we are concerned that my fiancee won't have her passport in time for the medical and interview (or before the NOA2 expires). She applied for her passport a few weeks ago (10/8/14) and it will take a few months for them to send it to her (things are backed up at her DFA).


I know the NOA2 approval expires in 4 months, and I know it's possible to apply to have it extended. My question is this: What is the best way to handle this? Specifically, I'm concerned about the timing of when we should apply to extend the NOA2 approval. Maybe a month before it expires?


Your thoughts are appreciated.

They would most likely automatically extend the expiration of the I-129F petition approval, but you could e-mail the consulate to be sure. You do not have to apply for the extension period.

thats really insane couple of months to have a passport. in my original country it takes 3 days to obtain passport and for extra small fee you can obtain it and get it in same day

The immigration process caused me PTSD.

The NOA2 will not expire by the date printed on the 797, the embassy will automatically extend the validity of the petition for up to a year... relax... all is fine.

There is nothing to do....that expiration date is meaningless in the K-1 process. Once NVC and then the Embassy has the case, it's open until they close it, either by granting the visa or denying or you fail to show for the interview.
Specifically, I'm concerned about the timing of when we should apply to extend the NOA2 approval.
You can't because it's not needed. There is no process to follow. You can delay the interview or go to the interview and then receive a 221g stating to produce the passport before any visa can be inserted.
Maybe a month before it expires?

Thanks Hank. I've done some more research in the forums and I get the impression that it's only automatically extended if it's the embassy that is causing the delay. I'm afraid they would say it's my fiancee's fault she didn't have her passport. That makes me think we should proactively ask for an extension at some point. I wish I could find official policy on this kind of situation...

Nope, that is bad info... the embassy will extend the visa automatically no matter, for sure does not need to be their "fault"... just keep moving forward all will be fine. If it concerns you email them, their email address is in my link.
