I met him online on May 2014, we met face to face on Sept 2014, he told me he want us to have our own baby since he is a 40 years old man without a child from his previous relationship so now i found out im pregnant. He was so happy and thinking about to process my visa to go to the US and hes wondering it might be more easy for him to get me since we're having our baby.

What would be the best thing to do?

Any suggestions? Thank you in advance

He can file for the K-1 visa for a fiancé since you don't mention being married.

Or

You can get married and file for the CR-1 visa.

Read the guides to see which visa would be better for you in your particular situation.

Being pregnant has no bearing on the how long the process will take. You will need to apply for a CRBA for the baby after it is born so it can get a US passport. No visa needed for the baby. This is if the father meets the requirements to pass on US citizenship.

As others have stated, you two can go for either a K1 visa or get married and file for a CR1 visa. Guides are to be found here:

Pregnancy will have no bearing on the processing speed.

On a side note, I have noticed that all you talk about is him. "HE wants a baby because HE is without a child" "HE is happy" "HE wants to bring me here", etc. I hope that is also what YOU want.

You being pregnant has no bearing on the visa process.

Quickest way to get your visa and you to the USA is the K-1 fiancee visa. The CR-1 spousal visa is another option, but that requires planning a wedding and getting married in the Phils before you can even think about starting the petition process, whereas with the K-1 fiancee visa the petition process can be started NOW. Plus once the petition is approved and things move toward the embassy phase, again the K-1 is faster as the beneficiary is more in charge of the process up to and including scheduling the interview, whereas the CR-1 spousal visa stalls out at NVC where they require a variety of paperwork and processing before the case file gets forwarded to the embassy, and NVC will doing your scheduling.

You want to get your visa quickly... do the K-1.

First of all Congratulatons!!

If getting a visa, and for you getting to USA is your first goal, then Hank is right in the K1 visa is the way to go. But you do need to look at all the options and determine you and your Fiances desires (it would also be good for him to be reading these posts). Remember this should be a joint decision and not just his.

But if you want to get married the quickest, and have a wedding with your family and friends, then going for the CR1 may be the better option. But of course this will delay you being able to get a visa and move to USA. There are alot of other issues that the both of you will need to understand as the CR1 may also have you giving birth in the philippines, again pros and cons with this.

If you are still pregnant at the time of your med exam, tell them at St. Luke's as they need to take steps to protect the unborn baby. Don't worry about things like chest x-ray because they are good at this and know what they are doing. Just make sure to tell them.

Your baby is a USC and entitled to his/her US passport, but you have to file a CRBA to make that happen. As for you, it seems clear that the K-1 is your fastest route to get to the USA.

If the baby is not born by the time you enter the US you don't need the CRBA. Only need if baby is born before that time.

If you plan for the baby to be born in the USA, please make sure there is some medical insurance or money for that, as birth in a US hospital can get quite expensive.
