Hi guys,

I am trying to understand this I-864 form before I fill it out, and I don't have my tax information nor my parents in front of me, but I do have some initial questions:

Part 6, question 5 asks for "current individual income" - are they looking for a match between this figure and your tax records entered in questions 13 a. b. and c? I currently have a job overseas but I should put "0" in this field because my job here won't continue and it's not U.S. income correct? This will conflict with the last tax return I filed because at that time I had a job in the U.S. Is that ok?

When my mom fills out the I-864 as a joint sponsor, for the same question, should she just include her pension or is this supposed to match with the income on her tax return? I think the income on her tax return will also reflect her IRA but I have heard that is considered an asset, so what should she use for question 5?

Lastly, if my dad and my mom filed jointly, but I do not want to use income from my dad (I'm not sure he has any) on question 6.a it asks if the sponsor is "using income from household members" and asks for the current income of the household member - my dad is unemployed and receives no benefits, so should "0" be entered on there or should income reported for both of them from tax returns be reported?

I am so confused , any help will be greatly appreciated. :(

If your job will not continue with you to the states, then you technically will have no income for visa sponsoring purposes. Someone will have to clarify if you need to put 0 or your foreign income since you still have to report that to the IRS.

As for your mother, she needs to put her CURRENT income, as in the total she will be making THIS year before taxes. People get raises, social security and other pensions get cost of living adjustments regularly. It is completely understandable that your current annual income is slightly higher (Or lower) than your previous year's reported income. When you provide payment stubs, proof of benefits/pension, bank statements, and your tax returns, they will be able to see why there is a difference.

Ok thank you. Do you know if Social Security will count as income? Also if she receives IRA payments, is this considered income that she should report?? Or assets that she should exclude? yikes.

And if my dad is now currently unemployed with no benefits, I would enter zero for him in the question where it asks about household members income, correct? But then I will use their joint tax income where it asks that?

Social Security can be entered in the Current Annual Income, but make sure that you provide the benefits letter and the last year's SSR-1013 ( I think that's the form) which is a Social Security Benefits Record that shows how much you were awarded in that year. I am on Social Security Disability and I had to write a separate statement explaining why I had listed income, but no W-2's or a job. As long as it is explained that her income on the I-864 is a reflection of her benefits, it will not be a problem. As for IRA's I do not know.

You're asking about your father's income and what to do on your I-864 or your Joint Sponsor's? Assuming your Joint Sponsor is your mom, she would fill it out accordingly, your father's income nor your mothers should be involved on your personal I-864 since you are not even living with them currently. I would ASSUME (i'm not a tax expert and far from an immigration expert) that she would enter her income/benefits as they are, and under Household Member 1 (Your father whom she filed joint taxes with) his household income. This means your mother will have to show support for a family of 4 though if I am correct, You/Spouse/Herself/Your Father. Not sure what the income limit is for that, but make sure you meet that. If i'm wrong, as always someone will correct me.

Thanks, I am using household number of 3 because I have been told before I will not be included in the household as I am not claimed as a dependent so it is only my parents and the beneficiary. Can anyone confirm this?

That might be correct information that you've been told. I assumed since you were not able to show that you could solely support the beneficiary, that the Joint Sponsor would have to show they could sponsor both you and him.

The social security info is 100% accurate though, I dealt with that experience on my own.
