I'm in need of help or advice for sending more Evidence. My husband and I thought we had given what was needed but come to find out they are requesting more and are not very to pleased with what we had sent them. Broke our hearts thinking what we submitted was good enough but looking at the letter I guess it wasn't good enough :(.

Here's a list of what they said we submitted;

  • an I-751, Petition to Remove Conditions on Residence;
  • a copy of the front side of a permanent Resident Card.
  • a copy of the reverse side of a Permanent Resident Card;
  • two copies of a passport immigrant visa page;
  • a copy of the biographical data page from a passport, issued by the kingdom of Nepal;
  • copies of separate identification cards, issued by the state of North Carolina;
  • a cpy of an identification card, issued by the state of Washington;
  • copies of separate social security cards;
  • two affidavits (husband's friend and a co-worker)
  • a copy of a 2013 Income Tax Return for single and joint filers with no dependents;
  • a copy of a Bank of America, combined statement, evidencing a ending balance of February 25, 2014;
  • a copy of Progressive Insurance, Auto Insurance Coverage Summary, with payment coupon;
  • a copy of a Certificate of Title, issued by the State of North Carolina;
  • a copy of two separate Sam's Club Advantage cards;
  • a copy of Residential Lease Agreement (renewal), dated November 01, 2013
  • various photos.

"your supporting evidence does not sufficiently demonstrate a bona fide marriage for the following reason; the evidence you sent does not show in sufficient detail that you and your spouse live together, nor does i show a significant commingling of financial resources, during the two-year period proceeding the conferring of conditional resident status."

It made us upset because a lot of our stuff has both address' of where we live, but we realize to we could have done better. in May 2012 and we both lived with my parents at the time in Washington State, then he was waiting for his Green Card to come in the mail before he could work and took a long time to get his Social Security Card. After that in September 2012 we both were given a Job in North Carolina so we moved, in October we opened up a joint bank account with Bank of America, Glad we did. (in Washington we tried but he didn't have his social security card and was trying to do a joint account with my credit union). so a lot of the stuff that we share has been since we moved here in September 2012.
So here's a list of what we are thinking to send and have so far. Please let me know if this is good or we could do something more to help this situation? My husband came in the U.S.

  • Lease document since we moved to North Carolina (October 2012-Present) we stayed in a hotel while working in late September 2012 to early October 2012 while looking for an apartment.
  • Car Title to the Van (the first one we sent, can I send again?)
  • Car Registration for a New Car we both purchased (both names on registration, I'm the buyer, husband is co-buyer. He doesn't have a driver's license but I do.)
  • Car loan 'SANTANDER' with both names on account but not on billing letters :(
  • Car Max (all documents and contracts when we purchased the New car in August 2014)
  • Bank of America joint account since October 2012 - present (Bank was nice enough to print all of it out for us with all the deposits, withdrawals, and purchases made)
  • Credit One card (copies of both cards side by side. Credit one won't have both names on any document for us :(
  • Progressive insurance with both cars under a policy, both names now showing insured. (I can only print out stuff online that showed my husbands name but on any letter doesn't have his name only mine.)
  • Sam's club letter that show's both names, but it's a renewal letter.
  • PWC (Electric Bill) letter (no bills with both names or any other document they can provide, just a letter saying we live at the same location but not saying since 2012)
  • Time Warner Cable (Document they printed out just showing both names and address where we live. But never a letter or bill with both names)
  • AAA Life Insurance ( we just got this, wondering if it will help?)
  • Pictures of old and new (from when we married to present, including honeymoon and vacations)
  • E-mails of our past dates

We stayed at some hotels in September 2014 but no itineraries because we drove up to Niagara falls and Statue of Liberty NJ, we have tickets for when we went to the statue and the Maid of the mist at Niagara Falls, will this help too?

That's all we can think of for now. Any suggestions, advice will be greatly appreciated. Thank you so much for your time and patience for reading all of this. :D

They are looking for a paper trail of the entire marriage, so just one bank statement probably isn't what they are after. A joint bank account statement every 3 or 4 months (including the transaction pages) spanning the marriage, same for utilities if you can. If you have other things like this, such as a copy of a previous joint car insurance policy, previous leases, and you'll need your 2012 taxes as well. The taxes should be the return transcripts, which you can download from the IRS website for free. Another good edition is if you have ever financed anything together, such as a vehicle, statements for that loan.

You need evidences with both you and your spouse NAMES on

combine financial ( bank statement for past 2 yrs, official tax return transcipt)

common residence (lease, mortgage,utility bills)

Children as a result of the marriage

Affidavits letters

Without these evidences, you are likely getting a RFE. All other evidences such as photos,

travel recipts are not the primary evidences they want. Letter with one name only count as share residence.

READ the rfe, just submit what they ask.
