Hey amazing VJ community!

My fiance and I are once again seeking the advice and counsel of all of you who've braved this battle ahead of us.

As I said in a previous post, my fiance and I were planning a wedding for December 13th, 2014, well within the 90 day requirement. Now, however, looking ahead at moving into and furnishing a new apartment, paying AOS fees, and a bunch of other expenses, we are kind of toying with the idea of waiting to have a big wedding till the spring when everything has settled down and we are more financially stable. However, the interviewing official at the Embassy casually asked us when we were planning a wedding and we told him December 13th.

Our question is this: is it okay if we have a little courthouse ceremony as soon as possible so we can file AOS and just focus on settling into life together in the US? Or do we need to stick with the date we told the officer? Are pictures of the wedding strongly recommended to send with the AOS package as evidence of the marriage? We are planning to add him to my bank account and have a joint lease, but can't think of what else we can send as evidence. We appreciate all your help! Thanks everyone!!

You do not need to stick with the date you told the CO. Many people do a small courthouse wedding and adjust status with no issue at all. Most people cannot plan a big wedding with only 90 days to plan it. Generally adjust status on a K-1 doesn't need much evidence of getting married beyond the marriage certificate. Doesn't hurt to snap a couple pictures at the court house and include them though if you can.

You don't need to stick to the date you gave. When I was interviewed in London I said I would probably have a courthouse wedding as it wasn't enough time to plan a big wedding and with lawyers fees and such we didn't have the money to do that. Any way we married within 90 days in a courthouse, no date given to immigration. All they are concerned about is that you do it with in 90 days.

As for evidence, I opened a bank account with my husband and we had wedding photographs taken and such, but this evidence is not required when you fill in the AOS forms, it might be needed in the future if you are required to attend an interview.. However what is required is your vaccinations records, your marriage certificate, your spouses birth certificate the 1'195 which is basically the card you were given upon arrival at the airport or the stamp in your passport, you can get this information online if you don't have it! I was helped by a wonderful member on visa journey who helped me understand the forms and such! Good luck!
