Temp EAD/social security card

My fiance came to the US on 1/11/07 and his POE was JFK. He got his temporary stamp there no problem. We got married on 1/20/07. Today being 2 weeks that he has entered the country and it was suggested to wait 2 weeks before going to Social Security to apply for his card we went to the office and was told they because he is not a fiance anymore his status has changed and we have to go to the immigration office for his status change before he can apply for the card.

We have not filed any paper work yet and the whole purpose of his going through JFK was to get the temp stamp because he has a job waiting.

I do not think this person at the SS office is correct. I have read that if one office does not work try another office.

What do you think?

I entered the US on July 31, 2004, got married August 28, 2004, applied for SSN card August 30, 2004. No problems. Received my card a little more than a week later.

You are definitely entitled to a SSN card with a K-1 Visa.

Either go to another office, or go back to the same office and ask to see a supervisor.

Oct. 22/08... U.S. Passport received

The guy kept telling me because we got married it changes his status. I said this is only temporary until we file for the AOS and EAD.

I think we are going to try another office in a different area and see what they say. I have read where other people were given a difficult time at one office and they went to another one with no problem.

If it is not one thing it is another. And we haven't started this process yet!!! :angry:

I might have been a little more pragmatic in how I phrased my answers with the "dude" at the SSA.

He's wrong. Unfortunately these people don't like being told they are wrong and they very rarely admit to being wrong. Try another office or just try the same one but aa different person/supervisor. Just don't complain or get angry they only dig their heels in..

The first time I went to the Social Security place the woman said that I would be sent one automatically and I didn't need to apply for one... Completely wrong, so I just went back and saw the same person and told her so. Just go back and shout at them! Haha

Thank you for your reponses. I knew I was right but did not want to argue with him. We are going to another office on Monday and hopefully have better luck.

Went to another Social Security Office and not one question or any problems. Card will come in 10 days.

Not sure they are right since he is still under a K1. you could at least get a temp number by just walkin in?

Did he have to ask for th eso much wanted stamped. I have a great offer and the embedded cost of not having it is to haigh for me to walk out w/o any stamp?
