Hi,

I have my AOS interview coming up soon, and on the notice I received it said to bring up-to-date tax return information for the Affidavit of Support (my AOS was filed in 2004, so we submitted 01, 02 and 03 tax returns with the affidavit). My co-sponsor has their '04 return, but has yet to file for '05. The instructions state that you must provide copies of your tax returns for each of the most recent 3 tax years. Seeing as my interview is before the tax filing deadline, will it matter if I have their tax return for '05, or will just 04 be ok? Thanks!

Our interview asked for the 2005 tax returns.

I would suggest getting them done before you go. If they are not done they may ask why since you should have recieved all your w-2 by the 31st of January

If you do not file at least have it done and signed, then file later(this is assuming you have to pay) if you get a refund, well what are you waiting for?!?!

12/31/07: Sent I-751 packet to Texas, the LONG wait begins once again!

01/03/08: Packed received.

You do not have to provide your tax return before April 15th. So, you will be perfectly OK. I had done my 2005 return but didn't even take the copy with me - this was on feb 17th. None was asked for. Good Luck

The way I look at it: why put off tomorrow what you can do today?

If you are going to file your tax returns for 2005 shortly and you've already got it planned, go ahead and bring that extra documentation. If you use H&R Block or Jackson-Hewitt or whatever have you, ask for an extra copy of the tax return and W2s. You're going to have them on hand anyways, right? :) (Or, in this case, if your co-sponsor has already done them or is planning to do them...)

If you haven't put together that package for income taxes and it's going to be a bit more stress you just don't need, then hey, don't worry.

I suspect that was just "boilerplate" language on your interview notice. If you want to hedge your bet, ask your joint sponsor for his/her W-2s (can put in a sealed envelope if they don't want you to see it).

Thanks for the suggestions. I'll talk to my joint sponsor and see how far off they are finishing their tax return. I'll ask them for copies of their W-2s if they can't get it done fairly soon.

Also, on the affidavit, on the bottom of the page where you list your income, there is a space to write the income requirements, and the year. I would write 2006, and use 2006's requirements, even if the most recent tax return I have from my co-sponsor is 2004, right?
