BRING SIBLING TO US WITH CHILD OVER 21 YEARS OF AGE

Hi everyone,

My mom sponsor my uncle to come to US! When we file I-130 petition for them, the children under 21 but when the time they get interview for visa the children over 21. Do they still eligible to come with them?

The I-130 petition for sibling on 2010, When do we expect them to get interview?

depends on the locking of the priority date and if/when CSPA rules were invoked.

ditto, how old were they whey he was petitioned? the closer to 21 when the petition was filed, the less likely they will be considered covered under the CSPA

You filed the I-130 in 2010 when the child was about 18. The visa number will become available in about 2022 (at current waiting times) when the child will be 30. Chances are very slim the child will qualify.

most likely not, I've seen children up to 24 or 25 due to CSPA, but in the 30's never. Once your uncle comes he can file for him
