So here is my long story, hopes this helps someone else….

We filed for AOS in December 2012. AOS file went to Missouri Servicing Center – NBC (MSC). We did Biometrics in January 2013. It took a while to do his fingerprints, as the worker was having a hard time with his pinky. After waiting 6 months we inquired with USCIS as to why we were past current cases being approved, and was told that it was sent to the local office to be processed, and we will hear from the local office. The entire time our case still said Acceptance.

Waited another two months and then we contacted USCIS, who contacted the local office, and they then informed us that the 6 months that it was at NBC does not count, they do not start the clock until they receive it, so we are not outside of normal processing time because they have only had our file 5 months. Waited another two months, and then contacted USCIS again, and they contacted the local office again, and we were told that it was due to background checks not completed, so our case is on hold until that has cleared. In November 2013, re-applied for EAD/AP thinking that will kick start AOS approval – NOT.

Waited another two months, called USCIS, and they contacted local office again saying the same thing, background checks not back. Made an Infopass appt. in January 2014, the person really was of no help, and she said the background checks are being done internally, so it varies who does the checks. Also, she said if we did not receive a waiver letter that we will get an interview. I told her waiver letters did not begin until March 2013, and we applied before then.

So after one year of waiting and no assistance given at Infopass appt., we involved our Senator, who contacted USCIS local office, and verified that FBI name check cleared, and that the other background check was not back, and that they will not request another Biometrics unless they need to. She was informed that everything was OK, but that was the only hold up and there is no certain date for return.

So we waited another three months, and then we filed with CIS Ombudsman who accepted our file. Then without a word, we had a home visit from the local USCIS office. I was out of town, but my husband was at home. They asked questions about our home, car, work, anyone else living in the house, and took pictures.

Then after three months, we receive an e-mail/text notification for a Biometrics appointment, stating that my fingerprint card on file with USCIS has expired and in order for USCIS to continue processing your application, it will be necessary to have your fingerprints retaken. So completed that appointment, and this time all fingers were in green. USCIS status then changed to Initial Review.

Soooo bringing up today, and got an e-mail/text On October 16, 2014, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you. If you move before you receive the card, call customer service at 1-800-375-5283. No interview. So it still makes me mad that after waiting 22 months we get approved, which means we still have to ROC.

Well at least we are done “FOR NOW” Good Luck to everyone.
