Now that my medical is done - i am looking forward to my next panic....cos i really dontknow what i would do without something to worry about !!!

Has anyone had any issues with the interview in respect of previous marriage ?

I am concerned as i as married for 17 years - sadly it didnt work out and to be very honest I was found myself involved with another person - which resulted in both my husband and I agreeing that we should divorce. After the intial reactions - we both sat and discussed what we would like to do in respect of divorce. My divorce paperwork does stated an unnamed invidual in the co respondant place - we both decided that there was no need to spend money serving papers on the person concerned as there was no disagreement as to the cause of the divorce- I am concerned this will become an issue - my Fiance was not even known to me when i was married and living in the marital home - I met my Fiance once i had moved out and awaiting the divorce to go through

Anyone throw any experiences on this?

The adjudicator is only interested in whether you are both free to marry. The cicumstances surrounding your divorce are a non-issue.

Many thanks - i was sure i had read somewhere that someone had been asked wether the person he was marying now was the reason for the termintaion of his intial marriage. I guess the marraige certificate will be to corroborrate with the divorce - cross reference on names ( in case of more than one marraige?) possibly a prevention of poligamy?

Thanks for your replies Guys n Gals - sometimes it is just reassurring to hear other peoples views and experiences -

Agreed. Have the originals of your divorce decree(s). Also I've heard they want the marriage certificate - not sure why, exactly, but I got mine just in case. :)

Do they really? Eep! For some reason I'd totally failed to spot that - thanks for the heads-up! :)

2005 - We met

2006 - Filed I-129F

2007 - K-1 issued, moved to US, completed AOS (a busy year, immigration-wise)

2009 - Conditions lifted

2010 - Will be naturalising. Buh-bye, USCIS! smile.png

We got a RFE because california uscis didnt like his divorce decree or mine - they asked for his and mine again!!!- all we could do was to send exactly the same ones back !.....however to be fair - he has been married 3 times previously - and they differ state to state - and yes we have discussed in full and frank detail that we are both doing the right thing this time in view of his record -i promised him that there is no way he will become america's answer to Henry the 8th - to be honest we have been pond hopping for the past 4 - 5 years in a bid to ensure we both understand the deal !

My previous marrage wasn't mentioned at all, but as the first thing that was said to me was "We pleased to be able to issue your visa", follwed by advice on what to expect when I landed and a warning about not opening the MBE, you can see that in fact no questions were asked at all.

I wasn't talking about for the initial petition, but rather, for the interview.

I remember us discussing this at length before (on the old board, pre crash). Can't remember if its packet 3 or 4 where its telling you what to bring to the interview, and prior divorce decrees/marriage certificates were requested.

Of course, that could now be out of date. Maybe someone here w/ a recent packet 3 or 4 can tell us for sure. :)

I got a copy of my previous Marriage Certificate. I may not need it, some want it some don't. You would think having a Divorce certificate would be enough. Whatever. The Courthouse gave a me a wallet size one, I won't bother trying to get a big one.

I personally don't think they care too much about what happened in a previous marriage. As long as you are free and legal to marry, it shouldn't be anyones business. If they do ask me, I'll be honest- "He liked to snort coke and f#uck other women, he had to go."

Hmm.... yup, looks like marriage certificates are mentioned in Packet 3 instructions - I guess I'd skimmed over that and thought 'doesn't apply to me' as I don't have any previous marriages! On the example in the Gallery on here (from the Warsaw consulate, for 'immigrant and fiance(e) visas') it says "married persons are required to present a certified copy of their marriage certificate. Proof of the termination of any previous marriage must also be submitted"... and in the instructions I printed from the London Embassy's site it says a marriage certificate must be presented "for each of the applicant's marriages".

I think I'd interpreted that as (in the instructions from Warsaw) that marriage certificates are needed for 'married persons' (ie people going for K3 etc - clearly K1 applicants aren't married!) only - so all you need for previous marriages otherwise is a divorce decree. In the London instructions, I was taking the 'applicant' to be me, the beneficiary... in the same way as I know they don't want me to get a police certificate for my fiance, I suppose!

Hmm... anyone? I *know* that he hasn't got a copy of his marriage certificate, and a quick Google has only so far found something saying you can write off for a copy and then wait 4-6 months! Everything I've looked at is going on about marriage licences, not marriage certificates... ugh. Has anyone actually been asked for the USC's previous marriage certificate? I mean 'been asked for', as opposed to 'taken it along just in case'....?

I am usually in the Canada section and we have discussed this. Vancouver seems to ask for previous Marriage Certificates along with the Divorce Certificate of course. It depends on the Consulate I guess. Most will get a copy, just in case it is needed. It doesn't hurt to be prepared for anything.

I dunno, Featherb, about what they will and won't ask for, but if its listed on packet 3, I'm happy we already have this sorted out.

I am surprised to hear that it'd take 4-6 months to get a copy of the marriage certificate for the USC (from your Google search). I was able to apply for mine online through the state we were married in. I don't think it took more than 2 or 3 weeks to get, and it cost $12.

I know, that doesn't sound right at all, does it? It must be available faster from somewhere else... in fact, it looks like you can get them from that Vitalcheck site, which is good news if it turns out we do need it. I did mention this possibility to him and he said (and I quote) 'that's silly, they don't need that'. He already thinks I'm over-panicking about all the stuff we need (y'know, the stuff it clearly tells you in black & white on the forms to send in/bring to the interview, that kind of stuff!!), I'm sure...
