I think there has been a lot of very good business council provided here. To show discrimination you are going to need to show that it has happened on more than one occasion and maybe you'll need to attached a protected class as well. Not an easy task.

Might be best to consider a new position at another firm where you wife will be much more appreciated for her skills.

Wishing you the very best! Please encourage your wife that not all Americans are nasty folks... there are many good employers out there :)

You may have a case. I suggest that you take it to the State Attorney General and also get one of the local TV stations to air what is happening.

Or rrrrrr you can relax and do what others have suggested. Have her find another job.

My wife was a school teacher also in the Philippines. Her degree is in Elementary Education. Do you once think that she would be qualified to teach here immediately? I don't think so. Its not just about education. There are a lot of other factors to consider. I do know that she would be one of the best teachers where ever she taught because of her unique ability to communicate and get along with others but her problem is with her sentence structures and pronunciation of words. I would not expect anyone to hire her as a school teacher until she learns or masters the english language. I suggested to her to take speech at one of the local community colleges. She may just do that.

When she first came here, she took a coarse to become a Certified Nursing Assistant. That is the field she is working in now. She arrived in April 2011 and by the end of August 2011, she had her first job as a CNA.

I made it very clear to her when she came here that she would have to start at an entry level position and go from there. Her first job was at a Christmas Tree Shop in New England. Her second job was a cashier at Walmart and then she became certified as a CNA after she completed about 12 weeks of class and hands on training at a nursing school. She is at her third job as a CNA. She has received accommodations at each job because of ability to care for residents at each of the nursing homes she has worked. Her first change of jobs was a result of relocation due to my retirement. She changed jobs once since we came here because of better pay and benefits at her current job. She also continues to take courses so she can eventually get a better job. I had to deal with some criticism at my job before I retired because of whom I married. It was clear discrimination but I sucked it up. You have to decide on what wars you want to fight. Is the current war worth fighting?

I agree. Your story is very similar to ours. My wife, also from the Philippines became a CNA just 4 months after arriving here. She has been employed at the same nursing home now for over 10 months and just had her first evaluation at work. Her bosses rated her excellent! There were no complaints. Interesting how Filipina's seem to have a knack for caring for others. And regarding your view on schooling in the Philippines you're also right. My wife is very smart but American History is not a real focal point in the Philippines. They focus on Philippines history, naturally, like we focus on American history. In fact a funny thing happend today while she was at work. One of the American nurses told my wife she looked like Pocahontas. (My wife had braided her long black hair) My wife looked at the nurse with a puzzled look. The nurse said, "Do you know what I mean?" My wife said no. They both laughed. Then the nurse realized that Pocahontas is American history. They both had a good laugh when my wife googled it on her phone. Once she saw the picture she recognized the cartoon from when she was a child but she had no idea that Pocahontas was a real person and part of American history. Perhaps you had to be there. lol

I have told my wife :

1) No jobs in any type of retail environment

2) No jobs in hotel / motel

3) No jobs in rest / bars / night clubs

4) No jobs on commission only

She does not need to work. She wants to work.

I provide everything for her.

I get 3 and 4, but 1 and 2? That is insane.

It's correct that the visual presentation of a message can detract from, and distract the audience from, the content of the message. Regardless, the OP is receiving some excellent advice in this thread.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I took a GM that transferred a few months later; her word, that she would "slide" my wife into the position the application called for in 1 or 2 months. She lied and ran, but she still works for the same company, cannot wait to sit across a table from her!!!

From a professional standpoint.... if you really were at some point head of a department for 20 years as you said, you would know for a fact that a GM's word, especially if it is the 'worlds biggest hotel chain' which would make that GM very low in the hierarchy of the company, means absolutely nothing. Contracts and written agreements are key in these situations. This whole revenge act of you playing the knight and charming armor and sitting across the table from this GM will not scare anyone and will in no way benefit your wife. But eh! to each their own, waste your time if you wish.

i wanna interject, before this topic gets locked.

stuff to review/research:

1. state labor board

2. state EEOC

3. federal EEOC

4. state hiring laws/practices

IMO - with a modicum of research on these 4 areas, you'll find the bits covering the violations that your wife has endured.

Finally - my last bit - if'n you want to 'speak on her behalf' - get/acquire a 'limited power of attorney' document.
