Well guys, they finally cashed our check....

I couldn't figure out which number on the back of the check is our casenumber... :(

I thought it was something like MSN and 9 numbers we had, but when I tried, it didn't work to login on USCIS...oh well...MAYBE we'll get a NOA1 hehehe

@Mae did you hear anything yet?

Diana

Congrats, Diana :D

FYI, I think the prefix is MSC, so you might want to try that.

But it is possible that it doesn't work even if you have the right number. We got our case number in July and it STILL doesn't work on the website. And when I call the automated line it says invalid. And the first person I talked to @ USCIS, said it was invalid too, but then transferred me to another person who said that he uses a different system and shows the case as pending and doesn't know why it shows invalid on the computer system....but oh well..... we have our interview date so I know they have our case, so I guess I shouldn't worry about it. But anyways, my point is that you might have the correct number and it might just say invalid anyway...

so we have changed our wedding date and i have a q...for the experts here.

we are now getting married on 1 October which is 9 days before his visa expires. wondering if we can wait out the 10 days for the certified marriage certificate and send in our aos package or do we have to send in the aos stuff prior to the expiration and wait for the rfe?

i'm sure this has been probably covered to death but i just didn't come up with anything when i searched for it.

thanks guys and gals!

Let me help you here :)

the K1 visa is the fiance visa and is just valid for 90 days after he got here. Within these 90 days you have to get married. You can get married at day 89, if you want to. As soon as you are married the K1 is invalid and your then husband is in limbo :) kinda where I am right now too.

You wait for the marriage certificate and then you file for the AOS.

My husband and I just sent the marriage license (signed by our officiant), because we didn't want to pay the higher fees....but we expect a RFE for that!

Important is just the date that shows, that you got married within the 90 days and you are save!!!

:D man, I sound smart hahahaha

Kang Lang,

By the guidelines of the K1 visa you have to get married within the 90 days. You aren't required to submit your application for AOS within the 90 days, but it is of course a good idea to do it as soon as you can so that you can get the green card as soon as possible. But don't stress too much if it is a little bit

outside of the 90 days. So long as you are married within the 90 days, you will be okay.

Just saw, that John & Diana responded too, so ditto on what she said :)

I don't know what state you are in and I don't think this works in all states, but it is something to look into: We were married by a justice of the peace and prior to our wedding day we let him know that we would be going through the process to get my husband's green card and wanted our marriage certificate ASAP, so the justice suggested that at the wedding he would give us the copy of the marriage certifiace to take the county clerk ourselves instead of him mailing it in. That way the county clerk was able to give us a certified copy of our marriage certificate on the spot just 2 days after our wedding. Now, I think this only works for certain states where they use the same document (Texas doesn't have a marriage license and marriage certificate, but only one document and once you get married the clerk puts an official seal on it and you are officially married). This process won't work for states where the marriage certificate is a completely different document, but it is something to look into in case it works for your state too.

Good luck!

Yay @ Diana! Happy for you! At least now you can be sure that your packet won't be returned and you also won't be asked for a new fee like what happened to MATTOB. Still nothing as of yet for us... Check remains uncashed and I'm getting frustrated and paranoid. We'll give it till next week. USCIS have started working on July 30 receipt date and I'm one of them so hopefully, I won't be waiting for so long.

They finally cashed our check last 08/27 and then I got the NOA on the 30th. We went to Arkansas for Labor Day celebration and a mail was waiting for me... Biometrics Appointment Letter set on 09/18 @ St. Louis, 8:00am.:dance::dance: After weeks of stressing out, they finally showed some life. HA! :D St. Louis is like 4-hr drive away from us so we've decided to stay for a night in a motel on the day before my appointment.

That's GREAT!!!! See, your Biometrics is even before mine. But our office is like uhm 15 Minutes away or so, so we don't have the hassle with Motel etc.

Well, we'll see, how long after that for our Interview huh?! Can't wait to hold that letter in hand. But before we have to get the address change done....I hope that wont be a problem (I can't see why it should be a problem, but then again...it's USCIS and our bad luck)

Well, I am really happy for you Mae. It's finally moving.

@Karoline Does your hubby have his GC yet?

Mae, Yay! So happy to hear you finally heard something! Biometrics is of course super easy. Paul was only there for maybe 20 minutes or so. They wouldn't let me in the building, though. I had to wait in the car. (Well actually I walked to a store that was next door and did some window shopping :P ) But anyways, its nice to know that things are moving. :D

Diana, no, no GC yet... We have our interview at the USCIS office on 20 September. So, hopefully, it will come soon after that. We applied for his AP & EAD too (in case his GC takes a while), and his AP just got approved on 4 September. So, we can finally go on a honeymoon out of the country (except that we don't really have the money for that right now, we spent most of our honeymoon money on our new place, oh well). I really really hope that his EAD gets approved soon or that his GC gets approved the day we have the interview. It will be ever so nice when he can work permanently. But yeah, that's where we stand now.

Just out of curiosity, Mae & Diana, can you check the status for your AOS applications on the website now that you have your NOAs? We still cannot. We can only check EAD & AP. But, again, oh well.

Alright, back to work for me.

Best wishes,

Karoline

Nope :( I tried a couple of times and did so just now, but I can't check it yet either. Might never be able to, like you...but you are right...oh well...as long as we get the mail, it's allllllllll fine :)

Congrats to your AP and the upcoming Interview! I am really happy for you guys! Good thing for him is, that he didn't have to change his last name, like me. That's a real pain in the #######, when you can't get anything official changed, if you don't have the greencard :( they don't care about the marriage certificate, the bank wanted the greencard....and since I couldn't offer that at this time they gave me the debit cards in my old name :(

Its frustrating, when you are married, but no one will accept it *sigh*

So I hope this 'nightmare' will be over soon and I finally can get everything in my HUSBANDS name

glad things are moving along for you guys so quickly!!!

i haven't even begun to think about the pain of a name change, i guess it will not be as difficult for me since i am the USC i think the marriage cert will work.

i guess we are the turtles of the december filers. i will admit the daunting task of aos doesn't seem nearly as bad since at least we are together.

have a great weekend everybody!

That is true! The AOS waiting time isn't bad at all. I mean I am not really complaining, it's just kinda sad, that nobody accepts the marriage certificate. It gets annoying when you keep getting mail in your old name, even though you are married. Well I guess it just annoys me/us so much, since I was married before and REALLY want to get rid of that old last name. It means it's officialy in the past and John and I are family (for everybody else to see).

Does it make any sense?!? lol (at least I know what I mean HA :P)

And hey...even turtles reach the goal...slower, but they do...and I am happy for you, that you at least can see the finish line

Soon, soon and then alllllll the troubles of the K1 are over and forgotten...and you are just happy to be married :)

Diana

PS: I see, that your fiance has his CA ID without the GC?! I didn't know, that I could apply for one before I receive the greencard...what did he have to bring? But I guess since my I-94 expires soon, I can't do it now anyways huh...oh well

totally makes sense! of course you guys are family and dangit they better get it sorted soon! ;). i'm surprised they don't accept your marriage cert. since it does indicate maiden and new family name. my bank told me it was all i needed but again i am wondering if it is because i am the USC. good luck with getting a speedy resolution to this green card/name change business.

i have already been coaching people about how to say my new last name and i won't be married for 3 more weeks! i'm kind of excited to take his last name even though it is sort of challenging for people to pronounce.

we are having a pre wedding getaway this weekend to disneyland. he's never been to any sort of amusement park in his life so it will be so much fun to be with someone experiencing it for the first time. i know we are a bit nerdy aren't we.
