We are from Nigeria. I am now a US citizen. Son was here on V2 but overstayed more than 1 year and now he is inadmissible although he's here. We are going to file I-601 ("extreme hardship") here in the States and want to know if they will order him to leave. Also, can he apply for extension of visa or adjustment along with the I601? I am very worried as I depend on him since I have glaucoma. Thank you.

He can stay in the U.S. on V-2 visa for an initial period of two years and can apply for further extension of stay of two years if a visa number is not yet available. The total number of years he can stay on V-2 visa is 10 years or until he is 21.

Are you filing the 601 in conjunction with an AOS interview?
