I've been married for over 4 years (06/14/10) have my PR for over 3 (6/09/11). My husband was just discharged from the Military for bad conduct, He was incarcerated for the last 6 months so i had filled an extension for our taxes and was playing with the system to see and i filed HOHousehold where i was getting more money back however i had him file 2 days latter an amended 1040 filing jointly. Will that affect my filing?

You can apply for citizenship based on your marriage at the 3-year mark, regardless of his military record. Concerning taxes, the only thing that matters is that you tax situation is current at the time you submit your application and anytime thereafter, and that is the impression I have from your post.

Good luck!
