SSN in maiden name. AOS/EAD in married name? Employment problems?

My wife and I got married 2 months ago on a K1 visa that expires in a week. We are sending the AOS form out today or tomorrow.

Question: My wife has an SSN in her maiden name. We are applying for her AOS (Green Card) and EAD in her married name.

Assuming that we get her EAD approved in a month, but the AOS much later, will she have problems working? Of course we have the marriage certificate as part of the paper trail, but is this enough?

As I understood we could not get her SSN changed until she has legal identification again (and the K1 visa expries very soon). I guess that the EAD is not identification, so she couldn't just change the SSN after getting the EAD - she would have to wait for the AOS to be fully approved.

Can someone please advise us?

Sorry i don't know the answer to most of your questions but i do know that most people on here went back to the SSN office with their marriage license and that is how they changed their name on the SS card. There is even a step for that in the K1 flow chart. See my attachment below:

EAD is a legal document, you can change name on SS card with it, apply for driving licence and get a job.

It is not where I breathe but where I love that I live.

^ that! Once she has her EAD you will want to go to get her SSN name changed. EAD and a certified marriage certificate will be sufficient.

BTW: OP- The K1 visa is a one-way, one-time visa that was voided once the beneficiary went through their US POE.

Every bride who takes her husband's last name (citizens and immigrants alike) have to go through the process of changing all their official documents (driver's license, SSC, employment information, passports, etc).

Assuming that we get her EAD approved in a month, but the AOS much later, will she have problems working? Of course we have the marriage certificate as part of the paper trail, but is this enough?

You and your wife can apply to have her SSC changed with evidence of the wedding license and her passport, it only takes a short time, and is easy enough. There should be no issues with her working so long as she gets her EAD, and updates her SSC. If she wants to work prior to the SSC update, she can simply show the evidence of her wedding license, however it should be updated ASAP.

The wedding license will be enough evidence as to why the name should be changed and a valid passport, along with her original SSC is more than sufficient for updating her SSC. You could bring the I-94 just in case as well, but it shouldn't be an issue.

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I had my SSN on maiden name too. Steps to take:

1. Wait for EAD/AP card, fill out another SSN form, than go to SS office.

2. On basis EAD/AP they change last name.

BUT

USCIS MUST upload ur wife's new name into the system so social security can see her new name. In my case, i got EAD/AP and SS accepted my new SSN form, but could not release SSN under married name, until USCIS uploads it into the sistem. I went to USCIS field office, asked them to fix the problem. Last update: went to SS and they said USICS released my new name (i got letter from SS saying in 2 weeks i will have my card)......still waiting.........

K-1 timeline:

11-07-2013 - I-129F form sent ---> 11-15-2013 - NOA1 - e-mail received, transferred to California Service Center.

11-20-2013 - Alien registration number changed.

11-22-2013 - NOA1 hardcopy (I-797C)

12-13-2013 - NOA2 approval notification ---> 12-20-2013 - NOA2 hardcopy

01-08-2014 - NVC recieved ---->01-09-2014 - NVC left

01-13-2014 - Consulate recieved ----> 01-14-2014 - E-mail from the Consulate
