Step Daughter's Case.

Hello All,

My wife Green Card got approved on October 8th, due to some errors my Step daughter case was sent late and her case got approved at USCIS on August 26 and then NVC received on OCtober 1st.

I explain that to the consul and said said that they would be requesting my stepdaughter case from NVC, not that I don't trust them but I want to be on top of things. The consul made a copy of my stepdaughter approved letter and stapled it to my wife case.

Can I request the case to be expedited before a CASE# and INVOICE# gets assign at NVC?

Please need you opinion..

Error is a reason for expedite. What did they do?

Well. It was an error on the part of my lawyer. My question is if I should ask for expedition now or wait until NVC Assigned a case and Invoice Number.

I have never heard of a Lawyer screw up being a good reason for a waiver.

Well. The reason I sent a second I130 is because my lawyer screwed up when he told me my wife 5 yeard old did not need an I130 if I mentioned her on my wife I130. The reason I will ask for her case to be expedited is because my stepdaughter which is 5 years old cannot care for herself if her mom decides to come to the US immediately.

When did you find out the child needed an I-130, before or after the mom's interview?

Before the interview. I found out once the get case got to NVC. I sent the child I130 on May and got NOA on August 27. NVC received it on September 27. My wife interview was last wednesday October 8th. The consul made a copy of the child NOA2 and said that the Embassy would be contacting NVC. NVC hasn't even assign a Case# and Invoice# yet.

Thats is why I was wondering if I should send an Expedite Request now with tha info or wait unitl NVC Assign a Case# and Invoice#.

I'm unsure why you didn't slow down your wife's case to wait for her daughter's?

You can ask for an expedite of course, but you have to wait for the NVC to give the case a number.

Yes you can, I asked for an expedite to NVC before getting my case number by email and got my case number within my expedite approval. Give it a try! Good luck.
