hi all,

i have received RFE on ROC we submitted on sep 2014 .... USCIS need couple of additional documents ... i have most of them but i am missing out with

1. insurance policies with proof of premium payments ( Low income don't have insurance)

2.evidence that me and spouse made Estate, health and financial planning arrangements with each other .. a will , a trust or power of attorney for healthcare or property , i don't have this as well.

what i can explain to USCIS regarding this stuff , please let me know.

If you don't have any of these things then you don't have them, and you should reply in a straightforward way stating as such, and why. Certainly, there's no point pursuing these documents now for the sake of inclusion (edit: although wills and the like are important, regardless of immigration!). At the same time, if there's anything else (large or small) you can think of to include then certainly add them to boost your evidence/case. I'm not usually an advocate of the 'everything but the kitchen sink' approach but in these kind of instances it wouldn't hurt. Ultimately, it would be a hassle, but if they're not satisfied the worst that will happen is they will schedule you for interviews.

No nothing yet at all but it is still early. I know VSC is super behind right now. I am concerned though because my husband and I don't have our wills done nor did we have any medical insurance at the time so I am wondering if they are going to issue an RFE. I had a ton of other stuff though to show co-mingling of finances etc. so fingers crossed that I don't receive the dreaded RFE.

From looking at the sept 2014 forum, it looks like Vermont has reached upto Sept filers so far. May be another two to three months for us.

Looks like USCIS is not even updating their online update system. My last update was when they sent out the letter of extension on Nov 24th. After that they have not updated the site. No mention of Biometrics completed etc.

i got RFE on 6th of sep.....i will reply to my RFE probably in 2 weeks ...again the problems is same no health insurance and no power of attorneys and wills. i will write a letter explaining why i don't have health insurance ... i hope they will understand the situation .

The way it is looking like, I think all Nov will be transferred to CSC. VSC is already close to a month behind and judging from previous years they transfer May/June filers and November filers. The only bad thing about that is that it will be almost 9 month before we start hearing anything or the other option is leave the applications at VSC and send a million of RFEs, because after the RFEs they have no official decision time, so they can basically extend a case for 12 months+. I probably sound quite negative, but when you look at it realistically it seems like the truth.

Fazal: How much information did you send in the first package? Was it extensive? Did you have joint bank accounts, credit cards, utility bills, life insurance policy-if any, savings account, brokerage statements, pics?

When we get ready to file for N 400...or even N 400, sometimes this Nov. they will be forced to make a decision.

Not exactly, as far as I know you cannot file for N400 while waiting on AOS.

I had asked about this to my attorney's office while I was filing my ROC. She said in Nov 15, you will be eligible to file your N 400 90 days before your 3rd anniversary of green card date, regardless they have made a decision on your I 751 or not.

I don't have :

life insurance policy-i brokerage statements - i don't know what impact it will have if i don't submit this stuff.

will submit photos and other stuff this time , hopefully this will work out.

This is not exactly useful information coming from an attorney. It is actually discussed here quite regularly as well :)

Plamjordan11 - are you adjusting status or removing conditions? You made a comment earlier in your post about not being able to apply for naturalization while AOS which is correct. And from what I can see on your profile you are listed still as AOS.

This forum is for removal of conditions and those who are coming up on their 3 year anniversary of their marriage-based green cards can go ahead and apply for naturalization, but you would not be able to if you are still working on AOS. Just hoping to clarify :)
