NOID for I130 (split from Yes you can visit)

i got a NOID for the I130 for permanet residence for my husband ?

please tell me what should i do ,

i applied for my I130 April 2013 and we didnt get any RFE , i just got an interview in my local field office June 2014

and all of the sudden i Got the NOID

im sooooooooooooo scared ,

help me pleaaaaaaaaaaaaaaaase

If you have received a NOID this is different than and RFE. Sometimes, you can get a NOID without ever getting an RFE. A NOID means they have questions about the evidence you have submitted and they might be requested additional evidence to justify their questions. You need to first verify that this NOID is in fact valid. You need to collect the necessary evidences that are being requested and review it all before you submit it. You need to submit these documents, ASAP! Make sure that you submit the original NOID along with the evidences. It is suggested that you update your case to premium processing at this point.

Typically you should submit this requested evidence within 30 days, if possible.

Additionally, what is there reason given for issuing this NOID to you? I hope this helps, contact me if you have additional questions. There is a strong possibility to obtaining an attorney could benefit you in this situation.

The US Citizen is always free to travel to foreign country to visit.

I am trying to find additional information for you, at this time. But, typically if you are in process of an I-130 petition travel into the US by the intending immigrant is not possible and could affect your case at the time of interview, as they consider this fraud. I would be very careful before allowing him to enter the US.

This is very wrong. Where do you read it is fraud to apply? That is so not true. Please don't post misinformation and scare people.

It is hardly fraud to apply for a visitor visa. It is fraud when you say you know no one and yet you visiting you husband or wife or fiance(e) that's what they speak of as far as a misrep.

So had to correct this Because many rely on VJ for accurate information.

Premium processing does not apply to them it is only for H1B filers.

OP. This is a Notification for intent to deny. You say you had a Petitioner interview at local office.

Is there something about your case that would make them calling you in. It's very very rare to interview petitioner.

Your NOID letter what did it request from you? I assume the beneficiary has not had their interview your case is still at USCIS or what? Is your timline complete?

What did the NOID letter ask you for? Normally they are asking for information. Is your petition at a local office? If so they often give out NOIDs instead of sending the typical RFE.

and yes my case is on the uscis local field office, i even did an anterview in my local office on june 2014

i even bring our skype calls, our facebook walls , some messages, some screen capture, our pictures , our birth certificates, ect ...

i think they have enough evidence is prouve that our relationship is geniune

So your case has never gotten past USCIS? Okay that helps.

So does it ask for evidence? They are saying your marriage is a sham. And it looks likely they are going to deny you. Now if you get denied that will be very key if its a denial and they say you can refile or a denial with prejudice which means you can't refile.

When did you get married?

How long have you known your husband before marriage?

Was it an arranged marriage?

When was the last time you have seen your husband?

You say you filed this petition April 2013 and it has taken over a year to get to this point?

Can you tell us word for word what they said in the letter and what they are asking of you to do now?

Did you mail with your I-130 any evidence proving that you were ever in the same country together? Airline tickets, passport stamps, hotel bills?

so , we got married on july 2012 and we knew each other on october 2011

and when i travelled to my husbands country we rent a house for a week and we spent 3 weeks at his parents house cuz its so big and it has so many rooms ,

and the last time i seen him was august 2012, i can't travel for more than a week cuz im working in us,

i so dont know what should i do , we so are in love, and i so dont know why they can't beleive us, im getting crasy
