Hello Everyone, My husband and I are in the K-3 Process, the I-130 and the I-129F have both been approved, and the I-129F is at the London Embassy. We are NOW preparing for his K-3 Interview!!! I have a question about multiple convictions. My husband (in the UK) has 2 prior convictions...one 21 years ago, and the other 11 years ago. I'm still confused about the "Moral Turpitude" situation, and WHAT actually classifies as "Moral Turpitude"??? But, the first conviction (21yrs ago) was labled as Fraud, because a 70 pound check...he was only fined in court, but never sentenced to prison! The second conviction was an ABH charge, again only fined, but never sentenced to prison.

So, my question is....since he was NEVER sentenced to do ANY prison time, will we need to file a Waiver for him to be approved for a K-3 Visa?

He also has another arrest on his record there, and one here in the US, BOTH of which were dropped before they ever even went to court!!! Can arrests be held against him in any way??? Or do they only look at actual "Convictions" PLEASE HELP!!?!?!??!?!?

I realize that there are MANY people in the "waiver" situation at the moment. My heart goes out to you ALL, and my prayers are with you. I assume we WILL be in the same situation, as we WILL need to file a Waiver, but I just needed input from anyone HERE that may able to give us any suggestions!

Even though my Husband has two prior convictions, they have BOTH been a WHILE AGO, and ALL we want is to be able to move on, be together as husband and wife, and live HAPPILY!! We love each other very much,and LONG for the day that we get to be together once again!

We have just had our case complete for the waiver and my hubby's offences were 28 and 34 years ago and he has never done any time in prison. To be on the safe side get your waiver letter done and your hubby's also, it is far better to be safe than sorry.

Good luck to you whichever way it goes for you, but make sure that at the time of the interview your husband has the I-601 and all supporting docs he can gather plus a hardship letter from yourself and a letter from himself to show he is rehabilitated etc. If you feel I may be able to help, please just pm me

Thank You so much for your Quick response! I am so scared and worried about all of this...and it gives me strength to read about Waiver approvals! CONGRATULATIONS!!!!!! :dance: There IS HOPE!!! I do have a question for you though, I just need to know WHAT we need to put in our letters to be filed with the Waiver, and the supporting documents etc.... What do I need to actually "prove" my hardship? I DO MISS HIM SO MUCH...and I NEED to be with him for Strength, He's My Husband...my FAMILY....but just saying that doesn't seem enough (to Immigration anyway!) Ya know? and about the Letter from HIM about his rehabilitation etc.... How can we show PROOF of any of that? Thank You SO MUCH for your HELP....I'm shaking as I type this...I just want EVERYTHING to be RIGHT for Him at the Interview...and with the Waiver etc.... CONGRATS ONCE AGAIN! Seriously - Repent and praise the lord for his forgiveness ! - that goes down well in the US

In the UK they just lose your records anyway so no forgiveness is needed....

Right this is what he will need to do first off apply to Scotland Yard for his police cert,costs a tenner and is supposed to take 40 days but it dosn't mine took 54 to get to me,that will show exactly what is held on the police computer,although the way CMT works is they look at the offence not what happens in court,so lets say someone got caught stealing that is theft and under the theft act I think it carries a maximum sentance of 5 years prison,although in most cases they would only be fined but the way it works is the max time for the offence you see,so like fraud will have a max sentance as does ABH.Also it dosnt matter how long ago they where commited either.

So you will need to file 601 but dont get too stressed about it,I did it with the help of my wife and I had a way worse record than your man and Im here in th U.S.

He will need to submit an I-601 waiver. The fact that he didnt serve any time is irrelivant, he was still found guilty and has the convictions. He will have no problem getting them approved because they were so minor and so long ago. I had two ABH convictions 6 years ago where I was fined $3000 for both. My fight was with some cops and I was approved my waiver in 5 weeks. (quick I know) but still. Dont let the waiver process scare you two, it will be a formality. :thumbs:
