Same-Sex K-1 Couple Needs Help With Marriage Planning

I live in Rochester--hi neighbor! My fiancé and I are planning our big wedding in May, but we will have to get married quickly when he gets here. We are probably going to opt for a Niagara Falls wedding with just the two of us. I don't know why the idea of a court wedding bugs me! We'll elope in Niagara Falls so at least it'll be special for the two of us :) They also have special packages for same sex couples!

Thanks for all of the great ideas! We actually like the idea of having a civil marriage first, then have a religious ceremony at some point in the future when we are not under a deadline. We are so happy to have support of other VJ members.

Actually the waiting period in DC is 3 business days from the date the license is issued. Also, you can hire a proxy to get the license for you since you don't live in the district. Here is a link to the officiant we are considering using if things do not work out in Florida:

http://www.marriagedc.com/services--fees.html

Based on the reviews I have read she is well respected.

Also, here is a link to instructions on how to get married in DC:

Good luck with your petition. It is so exciting to know that we can finally apply for our fiance(e)s

That would be helpful, but given who we are talking about, the only way for us to avoid a court fight is to vote her and the governor out of office in November.

Hello neighbor! I would love to go to Niagara Falls as I know my fiance would love it there. I can't wait to show him all New York has to offer.

Hi,

NY allows SSM so you will be ok, and yes there are some churches that perform SSM. I think some Presbyterian churches do, but definitely not any Catholic churches. If you get married by a church, you don't need to go to the courthouse since NY recognizes church marriages. The important thing is that you get legally married in order to do AOS, you can always have a ceremony later. NY greatly limits who has the authority to marry though, so most people get married in the county court or clerk's office. Unless of course you happen to know a judge.

To others who are thinking about getting married in a state where SSM is in legal limbo, don't. I would get married in a state that passed SSM on its own, not ordered by the courts. The reason I say is because if the bans on SSM are later found to be constitutional, we can't be sure that they won't invalidate all previous same sex marriages. Even though SSM is heading in a good direction, I wouldn't put my life in the hands of a divided court with Kennedy in the middle who can go either way.

This does not constitute legal advice.
