Hello guys

Iam totally broken and shattered now...i got my another 221g for the 3rd time in a row..First it was during the interview..then i submitted my wife's job offer letter and a letter from her sister that we will be staying at her place but they didnt approve and gave 221g saying that these documents are not sufficient ..So i submitted my wife's driving permit, Bank account opening papers including a copy of credit and debit card and also her dad's car insurance paper on which she is also included but today have been refused again...what do they want?? I mean, the VO during my interview asked me if we have rented out any place or we have our own house in US so i told her that no we will be staying at her sister place for some time So are they only looking for that??? How hard it is for them to understand that i want to be with my wife in US and the wait is killing me..Why do they even have DCF at first place if they dont want to approve

I have not collected my passport with 221g letter from stanley location yet but i am assuming that they will not specify what exactly they are looking for..like the last time around, where they just mentioned that document provided by u are not sufficient

but sorry i didnt understand lease between my Son in law???

What exactly did the paper ask for ? Maybe a lease between your SIL and wife for renting a room ?

The I130 is approval of family petition for unification purposes. DCF was started for medical emergencies, jobs etc so that the USC doesn't have to be separated from the spouse due to whom the USC sacrificed to move residence to a foreign land. So, to be able to make the process not so time comsuming, DCF facilitates on cutting down the wait. But, the reason it was started, has to be met. The USC has to have a reason to move to the US. So, the spouse can follow immidiately. For this, domicile has to be established for the USC. Sorry - this may be an inconvenience. But, still better than having to file in the US and still have to wait for domicile. The wait last year was almost over a year for the petition. So, be a little more patient and establish domicile by showing spouse's move and a rent deed and/or salary slip. Best of luck.

Thanks for taking out time in replying..She is staying with her sister who also living in a rented flat So hows it possible to show a rent deed on my wife's name??Also what other documents if any can be submitted in my next attempt?

I'm not sure but maybe your sister can have her added to the lease if that is possible. Then with her name on lease as a co-renter, this could possibly suffice or maybe a contract between her and her sister stating that her sister sub-lets a room to her for x amount per month.

I am no expert in these matters, this is just some ideas thrown out there. Hope everything works out for you.

If your wife is already in the USA, please provide a copy of her passport showing entry into the USA. Also provide a copy of her airline tickets (hopefully 1 way), boarding passes and a few time and date stamped photographs of the USA with friends and family with a backdrop of US city skylines, people and/or natural backdrop like lakes around Chicago etc. Provide a copy of the insurance and car registration to show that she is working on getting setup in the USA again. Good luck!

When i submitted documents for the first time for 221g, i did submit the airticket..also a job offer letter but that didnt convince them. and i got another 221g..then now i submitted a copy of her driving permit, her bank details with credit and debit card and since she doesnt have a car, so we added her name in the cars insurance along with her dad and submitted that also but today again i got another 221g

When does her job in the US start? An actual work contract and paystub from her employer Stateside would impress them more than a job "offer".

Your best bet is to have as many documents as possible. So literally collect AS MUCH info as you can find. I agree with Stressed Out above a contract and a paystub would make a great difference.

You mentioned her father. Where do her parents stay? Could they add her to their lease? You mentioned that your wife's sister provided a letter, what specifically did the letter say? Maybe the wording was not convincing enough. It has to be very detailed, as in listing how many rooms she has, in which rooms your wife stays and where you two will be living. By the way, if you also will be staying in that apartment, ideally at least your wife's name should be on the lease. Otherwise those kind of living arrangements are illegal. This is probably why the embassy did not accept that letter.

Your wife could have her name added to the utility bills for the apartment, those are usually accepted as proof of address, but the embassy might not, just a warning.

Since your wife is now working, could she rent out a place for the two of you? I know this is tough, but the immigration folk just want to be sure that she actually has the means to support you, is living in the US, and that you guys will be living together. I know you're frustrated but just take a deep breath, collect all the papers, and get it to them. Everything will work out! WIshing you and your wife all the best!
