I GOT MARRIED TO MY LOVELY WIFE ON THE 10 OF JULY IN AMERICA AND IM FILING THIS DOCUMENTS....FORMS I484,G325A,I864,I130,I765,I693(MEDICAL, DONE ALREADY WITH ME),AND G1145 RESPECTIVELY. ALL FORMS ARE READY AND PRINTED.HOWEVER, I HAVE PROBLEMS IN THIS AREA.VIS

QUESTION 1.... I HOPE THIS ARE ALL THE FORMS NEEDED AND IM NOT MAKING ANY MISTAKE?
QUESTION 2.... ON I485.. ADJUSTMENT OF STATUS PART 2 PAGE 1,SHOULD I TICK B,"MY SPOUSE OR PARENTS APPLIED FOR ADJUSTMENT OF STATUS.... "OR SHOULD I TICK H,OTHER BASIS OF ELIGIBILITY.... AND TYPE "CONCURRENTLY FILED WITH IMMEDIATE RELATIVE I130"?

Q1: If you are adjusting status from a student, work, or visitor's visa (the forum you are posting in), then yes it seems like you have all the forms (except where you says I-484 should be 485). If you want to apply for advanced parole (travel document before AOS approval), then you can also add the I-131 form.

Q2: It depends. Are you adjusting from one of the visas I stated above and is your spouse a US citizen? If so, then you will check option A (as aleful also said above). It reads: Attach a copy of the approval notice, or a relative , special immigrant juvenile, or special immigrant military petition filed with this application that will give you an immediately available visa number, if approved.

You will check option A. It reads: Attach a copy of the approval notice, or a relative , special immigrant juvenile, or special immigrant military petition filed with this application that will give you an immediately available visa number, if approved.

Since you are filing concurrently, that is the "petition filed with this application" (I-130). Option B does not apply, because your spouse is a US citizen and is not filing adjustment of status. The reason you are giving for H (concurrently filed with immediate relative I-130) is exactly what Option A says.

You basically will have two separate packages, one for the I-130 and documents, and one for the I-485 and documents. Now the I-485 packet will also contain the I-765 and if you still wanted to file I-131 you can include that too. I put each one in a separate folder and marked on each folder what form it included (I-485 or I-130) with both my name and the petitioner's name on each, and my alien registration number (which you will not have at this point since you are a visitor). Then both the petition and application will of course be sent off in the same envelope!

There are a lot of examples on VJ of cover letters. Mine looked partly something like this:

To whom it may concern,

Please find here enclosed my concurrently filed petition and application to adjust status from an F-1 Visa based on marriage to a US-citizen.

Included in this pack is:

  1. I-130 Petition for Alien Relative
  • G-325A – Biographic information for Petitioner
  • G-325A – Biographic information for Alien Relative
  • Filing Fee ($420)
  1. I-485 Application to Adjust Status
  • G-325A – Biographic Information for Alien Relative
  • I-864 – Affidavit of Support
  • I-693 – Medical Examination
  • I-765 – Application for Employment Authorization
  • I-131 – Application for Travel Document
  • Filing Fee ($1,070)

Then with each packet (A and B) I included a checklist of what each packet contains exactly in the order that I filed it. I basically did it in the order on this VJ guide: http://www.visajourney.com/content/i130guide2

I paper clipped the checks on the front of the respective application/petition.

I put the passport sized pictures into little ziploc bags and attached it to the respective documents also with a paper clip.

Edit: some people put the detailed description of documents they included on the cover letter. But that will probably be two or more pages, so not quite a cover letter anymore, which is why I decided to keep the cover letter as minimalistic as possible and make a detailed checklist for each packet.

I hope someone else would answer this, as I am not 100% sure. I did not have a joint sponsor so I never really looked into this. I tried to figure out if your two children need to be mentioned, but it looks like if they were not claimed as dependents on your wife's tax returns, then I don't see a category where they can be mentioned. So to me it looks like you were correct. I hope someone with more knowledge of this can confirm.

If your joint sponsor is not married and only has the two kids as dependents, than my understanding is that your numbers are correct. Again, it will be helpful if someone with more knowledge can confirm this.

If i buy money order of $1070 for i130, how much is the second one??
