Just an update on our situation: Matt got his EAD end of last month. He attempted to get his TN driver's license the following Tuesday. He passed the written test, then was told that they needed to get further auth from Dept of Homeland Security. Needless to say, this was extremely frustrating, as his EAD should be sufficient. The man said,"well, things may have changed since it was issued." I laughed and said he got it Saturday. What could have changed in 3 days? He replied with it is the policy blah blah blah.

Anyway, we patiently wait a week, Matt calls to see if they got what they needed and is told that no, it will probably take a month or more! He loses his %^&* and so I contact the senator office AGAIN.

She kindly agrees to inquire as to what it is they need.

We hear back today and it is a list: His Visa, His passport, My passport, the marriage certificate, the receipt of the I485, and I94. This is a joke. If he has been cleared at the Federal level for his EAD, why does our state need these documents and why can they not simply access his information online??? We have provided all these documents multiple times....
He is so upset, feels like he is being treated like a criminal and that this whole process inhibits people coming over and actually beginning a normal existence. He cannot even get his driver's license, which he needs in order to work, and provide for our family.

Omg that's terrible! I've never heard of that happening to anyone before. Is it common? I'm going for my learners permit soon.

Have you tried going to a different dmv or drivers license center?

You guys should have just contacted a different DMV location. But, according to DHS, people in AOS process need to provide:

1. Social Security Card, or letter from SSA indicating that SSA did not make a decision yet, or SSA rejection letter

2. 2 Proofs of residency

3. Immigration documentation indicating status such as I-797 Receipt Notice, Biometrics Notice, Interview Notice, Court Order of Immigration

Court hearing notice

4. One of the following:

• Employment Authorization Card I-766

• Passport

• Copies of documents certified by the Applicant's attorney or by an accredited Board of Immigration Appeals (BIA) representative may be

permitted if person's passport is held by immigration agencies in court procedure

So, these people are just giving you a hard time. EAD should have been sufficient. Download these requirements from the TN website (http://www.tn.gov/safety/driverlicense/dltemporary.shtml) and take it with you. Do not make a scene or you will be told what I was told that a DL is a privilege and not a right. They could outright refuse this privilege. They even called the cops on me so stay calm.

Yes it should be a combo card as long as you sent in your I-131 form with your I-765 form. Our case did the same thing, approved for AP and EAD but then only EAD information was being updated, and the wording made it sound like they were going to be separate things. When you get your combo card it should say on the bottom something about advanced parole. Hope this makes sense and helps you!

Quick question for those who have had experience or might be in the same boat as us. We had an RFE for our AOS responded and now the online case status says that on January 16th we should have a decision unless interview or fingerprints are required. I have a feeling January 16th is going to come and pass and there will be no update. Does anyone have any experience with calling the USCIS after the date has past, what information do they typically give you?

Was the RFE for the EAD or I485? I received RFE for my EAD after 75 days and my lawyer saidvi should receive my EAD and AP withing 30 days. I hope so, then i do not have to wait another 90 days. Usually uscis would tell you after 90 days but it will be approve withing 30 to 60 days.

RFE was for the AOS. I contact my congressman to see if he could help. Good luck though!
