USCIS will see it, mostly, the same way.

Now, if you married on Monday and filed the I-130 + I-485 set on Tuesday, would that protect his presence in the USA? maybe. unsure. there's regs about this in 9FAM.

VJ is a 'DIY' community, focusing on 'easier' stuff. Yer stuff won't be easy,

and most folk (myself included) would tell you that yer stuff is WAY beyond the realm of DIY,

and

suggest to you that you study over at immigrate2us.net {i hope I have the url right}

or find a competent immigration attorney that specializes in deportation orders, staying of/overturning of.

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

In a nutshell, you marrying him won't help with stopping the deportation. You don't have enough of a relationship to prove it is for anything other than immigration purposes. His USC children could be a help in stopping the deportation so I don't understand why he wants to try to lie about their existence.

You need to understand his court is not a fact finding mission where the judge will conduct an investigation. It is up to your boyfriend to present to the Court all the reasons why he should not be deported. Neither the judge nor the prosecutor will do this for him, it is up to him to present his side. Thus the need for a very good attorney. The DV charge will be a negative in the matter.

You are wasting your time looking for similar situations as the facts of each case are unique. If the marriage is legitimate, and if he was not found to have engaged in fraud in the first marriage, then generally you should win. It is a case of finding enough evidence. They are very good at uncovering fraud and usually capable of spotting a real marriage as well. Get a lawyer and start getting your case organized prior to his master calendar hearing.

Yes people have been in this situation before its called " FRAUD", but most of them get out of the situation by not marring, calling USCIS, ICE and reporting it. This is a HOT mess, like others stated but i will be very frank with you. You are a mark , i can tell from what ur saying that you are his next mark, he has an unborn child coming into the world and " YOu" want to marry him, he slept with someone got them pregnant and left them because he couldnt get along with them hummmmmm now this is a up standing man and he has done this 2 times. You know he is has major problems lying being the top one followed by DMV and you still want to marrying him. Girl wake up you are a MARK, this will destroy you if you marry.

You asked a similar case,I just posted that HE WAS DENIED ,he got married when in removal.,he didn't terminate the removal.BEFORE the AOS,and he is married for O6 Years.

Here's my two cents

Let's say you marry him... and he (miraculously) doesn't get deported. You sign the affidavit of support (guaranteeing that you'll support him for 10 years no matter). And let's say that as soon as his greencard has no conditions (meaning he doesn't need to stay married to a USC), he turns to you and says "for the good of my children, I need to leave you and go back to their mother." Are you going to be okay with that? Because there's a good chance that this is where this is going. If you're going to feel used and cheated if that happens, then you might want to reconsider marrying him.

Let's say you marry him... and he gets deported (hopefully, for your sake, without a lifetime ban). Then you spend the next couple years waiting for his ban to be used or spending a ton of money on a lawyer to file a waiver and then you get to spend more money to petition to have him back. That will involve more waiting still. And a lot of things in your life are going to change between now and the end of your waiting.

Here's what I recommend: Offer to move to his country with him and marry him when you get there or stay engaged to him and pursue a fiance relationship with him until his ban ends and then petition for him to come back and marry him when he returns. Either way, you have a chance to get to know him a little better before you commit yourself indefinitely to his immigration mess. Whatever you decide I hope the best for you

Do you hear how that sounds Totallyinnlove? They parted after you two met because he saw a better opportunity to get a green card. Of course that caused arguments. She was pregnant! Who leaves a pregnant woman? Is that the kind of man U want? I know love is blind but please slow down and think about yourself for a minute. Look at his track record. And please stop making excuses for him. If you two are so in love and his intentions are pure he shouldn't allow you to become involved in such a mess. As a man he should be handling his own problems that HE created. You do not need to save him. Two months is not long enough. Do you want to be used? Are you trying to get hurt? I don't want to see another loving caring person be taken advantage of. Slow down please.
