Its possible to AOS from a tourist visa???? Whats the point of doing a K-1 then?

At least for me, my fiance was denied her tourist visa because she was in a relationship with me. So that makes it impossible.

Also, if you plan on doing the AOS on the tourist visa, you are technically committing fraud. That said, my brother did that when he married his wife from Canada.

It's considered fraud getting a tourist visa with the intent of getting married. They will "forgive" it though once you start the AOS process.

Unfortunately, unless you are in a country that has a tourist visa reciprocity agreement, it's pretty tough to do since you have to go through an interview process for the visa.

Not necessarily. I remember a spanish girl from VJ who went to visit her boyfriend in the states, and when she was about to leave, he proposed to her and wanted her to stay. She did not have any immigration intents at POE (Which is what counts). I imagine this route may be a little difficult for some though, as most of us would need to go back home to fetch our belongings and important documents.

Ok, here's the deal. It's not "illegal" if you magically decided to get married once you walked past border control. As long as the thought never enters your mind until you are in the US you are home away.

Yes. All the time. The reason there are some jokes about it on here today is that there is a thread elsewhere on the forum discussing this.

It's not fraud if you had no immigrant intent at the time you entered the US. We were not willing to take the risk. We paid for it. It cost us and most others at TSC almost a year of our engagement time together. However, we feel our relationship was worth too much to justify even a calculated risk.

Not really sure, I could ask my brother...but I do know his still ended up taking 2 years from start to finish. At least his wife was able to live with him through the process though.

Nope. That's what others say here. Proof of bona fide marriage is all they look for.

I went to spend Christmas and New Year with William. I had zero immigrant intent. I had left my house, my job, my family and everything here and packed for a vacation. While there, it occurred to us that if we did decide to get married on that trip and I stayed and adjusted status, I would genuinely not have done so fraudulently. We were already 5 months into the application as as per my previous post, there were reasons we didn't entertain this. However, there are situations where it's not intent, obvious or otherwise, for couples to get married on a vacation visit.

The USCIS person we spoke to (who for once was lovely) said it didn't look like we were transferred as expected.
