Hi

In 2002 I visited the US and, since I am a german cititzen I used the WVP.

Due to various circumstances I ended up staying about 2 weeks longer than I was supposed. To make a long story short, when I wanted to leave the US they cought me, put me into detention without giving me the choice of voluntary depurture and eventually deported me. Plus the banned me from the US for 10 years.

Back in germany I contacted a laywer to get more information about my case. He said that I wasn't supposed to receive a 10 year ban for an overstay of only 2 weeks. The guy from the border police probably had had a bad day that day. The lawyer told me that I could object the ban, having it reduced to probably a half year.

I didnt end up doing that since I had no intention to visit the US in the near future anyway.

The time of the ban is over and I am wondering if there is any chance for me to get into the VWP again.

I've been working for a germany based company on various projects worldwide. In the past few years quite frequently in South America. It's always been a hassle to find flights that dont have stopovers in the US. Applying for a Visa (B1 I think) every time I'm traveling would be even a bigger hassle, especially because I'm usually traveling on very short notice. The embassy is about 5 hours away from here, I'd have to call them to get an apointment which probably takes 2 weeks... So this is not really an option for me.

It'd be awesome if someone could give me some tips

thx & br

Once you overstay on the VWP you are ineligible to use it again for life; you would need to obtain a visa to visit the US from now on.

You need a B1/2.

The ban was for being deported.

I'm surprised you were caught on your departure. What happened exactly?

As Boiler stated, your ban is not due to the overstay, but rather the deportation. A two week overstay alone does not result in a 10 year ban. B1/B2 visas are for business and tourism respectively. It does sound like what you want is to just transit however.. There is also a C visa for transfer at airports. It would allow you to transfer flights at a US airport. The C visa may be slightly easier to get than the B visa.

Usually, you would not have to get a visa every time you travel. Most B (and C) visas are good for a given amount of time. Generally 10 years for the B visa, though it may be different in your situation. They're usually multiple entry, meaning you can enter the US on the visa for as long as it is valid.
