My husband has his 2 year conditional visa. (Right now he is able to travel back home to Costa Rica and has done so but I have heard that once we file for AOS he will have to wait 2 years to travel out of the US? Is the correct? Or is it just from the time we file to the time we are approved that he cant travel? Please advise.

When he applied to have his conditions removed (which he can do 90 days before his conditional green card expires) he will receive a NOA and a letter stating that he will receive a one year extension on his green card that will allow him to travel and work while he is in the process of having his conditions removed.

Patience is required for this process.

Your husband is an LPR. He should not be applying for adjustment of status.

2 year conditional visa? Do you mean the 2 year green card? Like others have said, you will file to remove conditions, not adjustment of status (AOS). Different forms and different process.

9/4/06 - AOS package accepted at Chicago

9/11/06 - ND AOS package

9/14/06 - NOA AOS, AP and EAD

9/16/06 - Biometrics letter received

9/18/06 - All touched

9/19/06 - AP and EAD touched

9/20/06 - RFE notice by email (verify income and employment)

9/23/06 - Biometrics

9/25/06 - NOA I-130 (finally)

9/26/06 - Touched AOS and EAD

10/4/06 - Returned RFE materials by USPS Express mail

10/5/06 - RFE materials signed for by D Atwell

10/12/06 - E-Mail notification RFE material received 10/10/06

11/3/06 - Received interview notice (for 12/18/06)

12/18/06 - Approved with letter in hand (no stamp)

1/3/07 - GC in hand Remove conditions 9/18/08

Hmm,

I can figure it out.

I'm pretty sure she means he currently has a K-3.

Once the K-3 expires, your husband will need to have a green card or AP document to travel out of the US.

Because the way I read it is that he has a K3 visa that is multy entry valid for 2 years.. so he is allowed to travel and she is asking if he can still use his K3 to travel after they have filed for AOS....

Thanks everyone, and sorry for the confusion. I should have posted on the Liftting conditons board not AOS (I was confused). Here is the situation, my husband does not have K-3 Visa he has a CR-1 Visaa and yes, I meant two year green card not visa. Sorry! We filed for DCF in Costa Rica. He has his green card which is good for two years and then we have to file for lifting conditions. He is free to travel now but I heard somewhere that once we file to lift conditions they will tell him he cant travel out of the country for a certain amount of time. Can anyone point me in the right direction to find out if this is so? You guys are most wonderful.
