If I remember your case correctly you have no grounds for an abuse waiver since you threw him and his mother out of the house and got a restraining order. And had him arrested on false charges. And he never laid a hand on you.

For the divorce waiver you must have proof of a relationship that existed after you entered the US. You have none since you threw him out of the house.

Add to that the fact that he notified USCIS prior to your entry to the US that he did not want you here and he was filing for divorce.

So could you give more details on what, exactly, you plan to use as evidence?

This person is planning more fraud attempts and looking for help. Although I think USCIS is more than aware of her antics already. Her time is limited. And no agency is going to take a report seriously about what someone read on an internet forum.

Not to be caustic or inflame others. Just a simple observation. Where are you from? How many times did you say you wanted a divorce? He may actually not be married to you depending on your answers. All he has to do is show that to a court and they are legally bound by the laws of the country you were a residence of. Were you married under Islamic rights by chance?

Also, by PO do you mean Restraining Order? I know in some countries they call that a Protection Order. If so, those are not always held up as a positive note for you. All he would need to do is print off what you are saying on this forum (which can be used as a witness in court) and use it against you. Legally they are required to send it to his lawyer in most states now. Even if you tried to delete it, there is a copy of all the forum in "The way back Machine".....

Just so you are aware. I had a friend that thought he was legally married to a woman. She even got a green card and was in the US. They found later on that he was not legally divorced previously when the marriage happened to her. She had already asked to divorce the man and claimed what you are claiming now. He just showed the judge the papers that his previous divorce was not final, and her Facebook messages. The judge then petitioned to have her removed from the United States. So there is a precedence of this occurring before.

Personally I find this whole situation horrid.

It will be a long stretch because no name calling here or for that matter any personally identifiable information released here. It will be challenged by the OP in court and will probably be upheld. Facebook, Twitter and LinkedIn will be whole different ballgame though.

I am still interested to find out how the whole situation is actually possible in USA.

i just read your previous thread posted on FEB ? why the divorce is not final if he started divorcing you? where do you live?

when you will get the divorce and you will be living in your own house, you can remove the condition in your card, just move from this man house

I am still here.

I have a valid CR-1 visa.

Filing for divorce soon and applying for permanent residency through abuse waiver as well as through divorce if absue path fails. Does anyone else have experience with filing multiple waivers for green card?

Hopefully, I will get it approved soon.

Luck is always by my side.

I am not sure if the OP is the wife or a husband posing as the wife to make her look bad.

I did not know it was possible to file multiple waivers for the same petition.
