NVC Filers - October 2014

I need someone help please:

I don't have a attorney for NVC process and today I got the checklist for AOS package, even though I have reviewed my forms throughly before sending it. My father in-law is the joint sponsor for AOS so I have filled out two i864 forms one for my wife and one for joint sponsor.

I have all the tax transcripts from last 3 years for both of them - since my wife didn't work last year I have included my father-in-law as joint sponsor and now the checklist says:

With my (Father in law's name)

[x] Items 13.a.1. The income you enter must match the total (gross) income reported on your most recent Federal income tax return. If you filed Form 1040EZ, use the adjusted gross income instead.

I have double check the tax transcripts for 2013 (Current year) and the gross income is still the same as I mentioned in the form

What could be the problem?

My father-in-law has his own business (Vet Clinic) so he filled 1040 jointly with his wife. We didn't included anything for his wife because she doesn't work. ??

I don't know how to approach this issue?

Since he owns his own business, he needs to use the adjusted gross income regardless of what tax return he filed. Self-employed people's income is treated differently to normal employed because the consulates take business expenses into account to determine the sponsor's income. There was someone else here a while ago whose joint sponsor made in excess of $50,000 a year, but because they had expenses of around $45,000 a year, their income for the purpose of the I-864 was only around $5000 or so. Way less than the poverty guideline, as you can tell. If your joint sponsor's net income after expenses is less than the household size poverty guideline amount for your case, you need to find another joint sponsor. Preferably someone who works for an employer or someone who doesn't have so many expenses in their business.

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

The NVC rep told me on the phone that they finished reviewing my docs but they are missing my husbands i864 (for the second time bc i already got a checklist for this 3months ago). We have sent it. Does anybody have info abt this situation??? This will delay the case even more ...

They have most likely overlooked it. Call and demand to speak to a supervisor. Then give him/her the tracking info and be very ask that they look through your file again and insist that they have this information. They have a history of over looking documents.

How long does it usually take for it to be available to pay?

On the Document Cover Sheet that I received yesterday (and again today with AOS invoice), it doesn't have an address where i need to send both packages. Is that normal? Also should i use the address on the NVC's website?

2014/12/23 - Interview - going to try to move up a week but we will see.

2014/12/2 - interview and APPROVED

2014/12/18 - Smooth and quick POE at LAX then onto JFK by domestic

Im just filled with joy, Im on my 7th month in NVC and I got my Case Complete today!!! Im so excited now just gotta wait to see when the interview date is to start making arrangements at work and flight details to go to the interview with my wife!!!

How exciting after 16 months of this process Im hoping I'll be done by the 18 month line, when originally I thought i would be done a year ago lol

congrats to all others whom are receiving good news on the next steps on their cases, abd good luck to you all.

And thanks for all of your help and support through this long and difficult process.

That what I did - I have included the GROSS ADJUSTED INCOME and they came back to me ask for only (gross) income and adjusted gross income is for the one who filed 1040EZ.

My father-in-law is a doctor (vet) and he make enough money to support me excluding his expenses. Now i'm not sure what to include and the worst part is that I have wait again?

I just called NVC and operator told me my case got completed on Oct 7.

Now this is what he said or I misunderstood him...I will get CC e-mail in 5 business days if they are not able to schedule the interview in that time. When interview gets scheduled I'll get e-mail informing me about that.

(If this is correct, i'm guessing what he was trying to say is, if they don't get my interview in this round while they are doing scheduling, then they will send CC email and I will wait for next scheduling time)

Does this make any sense? or I just didn't get what he was saying....

His wife should to submit an I-864a because they file jointly.

Also your issue is the most common one. Even if they're correct the NVC incorrectly asks for this to be fixed frequently. I cannot fathom if it's a problem with their software or eyes.

But the Checklist did not ask me for another I-864A for his wife. It specifically marked item 13.a.1 and said to correct (gross) income. Originally I have filled out adjusted gross income.

Am I missing something here - I'm totally confused now????

Ugh. On Monday I called the NVC and they said that my AOS packet was approved on 10/2. Woohoo!

So today I got what I thought was a false checklist for my AOS packet, but I called to make sure. Yvette said that it was not a false checklist. It says that I didn't include the proper number in line 19, and that I needed to resubmit I-864EZ with the right number (total income). I looked at my 1040 and my tax transcripts and I did report the correct number (Line 22 on 1040 and "Total Income" on my tax transcripts! She even looked at it and said that the number I was reading was correct. They are wrong!

...however, she said a supervisor would need to review it, and that would take 42 days! Are you kidding me???? And then, of course, after the supervisor review, if they still thought I was wrong, I would have to send in another I-864EZ for them to review if I made a mistake.
