Hi. Were also surpised that my son needs i864w cos we send the i864 but got checklisted. On the checklist, they explain that my husband should file i864w since our son will benefit from the Child Citizenship Act of 2000. On his BC, husband was still a Filipino Citizen, he just naturalized a month after our son's birth. But then, on the factors, son is less than 18, petitioner is a naTuralized USC, and soon will be living in the US upon pursuing permanent residency, so I think he qualifies for the CCA of 2000.

Would you please share the timeline for your son's checklist. The date your received the checklist, send the new I864W and when was his case complete.

We have a similar situation. My case is complete but we got a checklist for my daughter and I am trying to figure out how long it will take to process her checklist.

I don't understand about i864W.

Instruction for I864:

"The following type of intending immigrants do not need to file this form:

...

2. Any intending immigrant who will, upon admission, acquire U.S. citizenship under section 320 of the Immigration and Nationality Act. as amended by the Child Citizenship Act of 2000 (CCA)

...

If you qualify for one of the exemptions listed above, submit Form I-864W, Intending Immigrant's Affidavit of Support Exemption, instead of Form 1-864."

Your son has american father in his birth sertificate?

Yes. Like she stated her son will be a citizen soon as he arrives in US so I-864W applies to them . Petitioner is US citizen.

Hi everyone,

My husband is expected to come home on October 23rd after almost 2 years of being gone! We are very nervous about POE though? Does anyone have any experience or knowledge of being refused entry on a CR1 visa? After my husbands first attempt at an E2 visa was denied, he tried to come back on an APPROVED ESTA, but was sent back home after a 10.5 hr hold in customs in LAX. They told him to go back to Aus and come back with a B1/B2 visa. He was denied that visa, then tried again for his E2, but again denied due to lack of investment (over 100k, btw), which is when we began our process for our CR1. One of the reasons he was denied his B1/B2 was because he was coming to invest more in his business and he had overstayed his ESTA by 14 days the last time by accident. The consulate was all very aware of all of this and interviewed him on it as well, and approved his CR1 visa.

But like I said, we are terrified that he will get refused entry when he comes home on this VALID visa. Are we freaking out or do we have actual legitimate reason to worry? He has no criminal record, isn't involved in any illegal activity, and he is coming on an approved CR1. Anyone with any guidance or advice, please help!

Please do not worry too much. Australia is a low-risk country. The fact that you have married and have gone through the CR1 process should make his entry fairly pain-free. Are you traveling with him? That might make it even easier. I traveled from Australia with my spouse (I'm the USC) and we were through immigration is less than 10 minutes (at JFK).

Since you declared all the above and was grilled over it all during the interview, you should have no further issues, as Sukie and dwheels said. I don't blame you for being anxious though. I would suggest you both travel together and carry the stronger of your proofs of relation with you for good measure. Take heart in that they specifically told him he could enter with a B1/B2 visa. CR1 is loads better.

PS. It was a good thing he wasn't given a ban on his second POE denial.

Timeline

I got CC, interview letter and interview date for Nov 24. Questions:

1- Am I supposed to get an email from the Bogota Consulate with further instructions, or just follow the information on the Travel.state.gov for the Bogota Consulate?

2- The $404 for the visa, do I pay them before the interview or on the day of.

Would you please share the timeline for your son's checklist. The date your received the checklist, send the new I864W and when was his case complete.

We have a similar situation. My case is complete but we got a checklist for my daughter and I am trying to figure out how long it will take to process her checklist.

Hi everyone,

My husband is expected to come home on October 23rd after almost 2 years of being gone! We are very nervous about POE though? Does anyone have any experience or knowledge of being refused entry on a CR1 visa? After my husbands first attempt at an E2 visa was denied, he tried to come back on an APPROVED ESTA, but was sent back home after a 10.5 hr hold in customs in LAX. They told him to go back to Aus and come back with a B1/B2 visa. He was denied that visa, then tried again for his E2, but again denied due to lack of investment (over 100k, btw), which is when we began our process for our CR1. One of the reasons he was denied his B1/B2 was because he was coming to invest more in his business and he had overstayed his ESTA by 14 days the last time by accident. The consulate was all very aware of all of this and interviewed him on it as well, and approved his CR1 visa.

But like I said, we are terrified that he will get refused entry when he comes home on this VALID visa. Are we freaking out or do we have actual legitimate reason to worry? He has no criminal record, isn't involved in any illegal activity, and he is coming on an approved CR1. Anyone with any guidance or advice, please help!

Hey there, I think there wont be any issues at POE. He has cr1 visa which is legal. Make sure he takes marriage certificate, and the other previous travel documents. Good luck :) I booked the flight for Oct 20th. Im nervous too. Before that I need to pay the Immigrant fee payment$165. Hope everything will be fine.
