That is what shows in her profile. She simply needs to know the process for there, still tied to the marriage license is my thinking

I get so used to Filipinas marrying USC's and rarely seeing the opposite, that its easy to just assume :lol:

Hehehe... Yes... it is rare to see the female as the USC and the male as the foreign fiancé... but we do exist lol...

Oh I certainly know it exists, but its got to be only a couple out of a hundred. Even rarer is the female USC that marries the Filipino and goes to live there, but I know of a couple cases of that two. Its just not my default mindset, so I can get taken off guard. Congrats on the marriage!

Hello everyone!!

I am happy to say that my fiancé (now husband) and I married on September 20, 2014.

We are getting ready to file for his AOS and EAD.

I was just wondering... Upon filing, do I sign everything in my married name even though I haven't legally changed my name yet?

Any other FEMALE petitioners out there??

I'm a female petitioner. When we got our marriage certificate, I changed my name to his. But I have not yet gone through the process of changing it on anything else yet. My plan is to wait until after October 11, when we are having a ceremony for friends and family, who don't yet know we're married. His AOS papers really concerned only him. I signed my previous name on everything that required my signature. I will change my name soon, but I haven't used his name on anything yet.

Timeline

In most states, once married your simply start using your married name, there is no process, so you use your married name for EVERYTHING... including AOS documents!

You grab a certified copy of you marriage certificate stop by SSA get your SS card updated, you get your driver's license update, the bank... well you get the idea.

More often than not, you will not be allowed to update your name on your SSN with just a marriage certificate. We attempted this in Phoenix and were denied and told that we have to have our EAD at a minimum. I even had the AOS NOA-1s and they said that wasn't good enough because they have to verify the new name in the SAFE database.

We also got the same run around with Arizona MVD. They would only issue my wife an ID card in her maiden name (which is the name on her K-1). Funny was that in Arizona you sign a card for your photo for the ID first, then turn in the form for the ID, and she signed it in her married name, but the ID was issued in her maiden name. So her signature doesn't match her ID! :oops:

The bank didn't care about needing an EAD and happily added her to my account with her married name.

So I guess you don't want to hear that we went to SSA and applied for the SS card in her married name two days after we were married (Traditional Philippine format), brought a copy of her I-94, passport and marriage certificate.

The marriage certificate IS the required document for changing the SS card to the married name, SSA wants to see a certified copy. One other fact is that SSA requires they be notified when you get married and change your name. You got one of the many idiots working at SSA.

PLUS SSA requires a person to notify SSA when your change your name so they can update the records. You for sure got an SSA idiot. The card has already been issued (in your case) they do not have to check SAFE again, they just have to see the marriage certificate (certified copy will do).

Name change

If you need to change your name on your Social Security card, you must show us a recently issued document as proof of your legal name change. Documents Social Security may accept to prove a legal name change include:

  • Marriage document;

Hank was correct. There is no reason to worry about SSA workers that do not understand immigration laws and the K-1 visa. The person that started this topic is a USC. She did not enter the US with a visa. She does not apply for AOS or get an EAD. She just goes to the SSA with her marriage certificate to change her name on her SSN.

OP> Your husband is applying for AOS so it does not matter much what name you use on the I-864 or anything else for his AOS. I did the same as the other person in this thread that stated they did not use their new married name for her husband's AOS forms. I planned on taking my husband's name, but did not change it right away. By the time my husband needed to file for ROC, I had everything changed over and used my married name then. The USCIS had no issues with doing it that way. They won't have any issues with you going ahead and using your new married name now on his AOS paperwork either. Whichever way you want to do it is fine.

Bleh, I am not surprised about this. I argued with the lady and provided documentation, but she was insistent... Oh well...
