Time between Temp. stamp and EAD...

Hello,

If you get hired fulltime when you have the temp. stamp and you know there will be a 3-4 week period until you have the EAD in two months is there anyway you can keep working during that time and the employer is fine with it or do they get in trouble and won't even hire you??

If the employer doesn't care, it's fine. They are the ones who could potentially get in trouble so it's their risk.

If the employer doesn't care, it's fine. They are the ones who could potentially get in trouble so it's their risk.

Thanks! So how exacly would they get in trouble? So I should straight up tell them about the situation and they will decide?

They would be in violation of the employment law... form I-9 is the form they have to complete to say that you are employment authorized and they have seen the EAD to prove it...

So... recommendation is to get a temp job and then get full time when card arrives? My Social says authorized to work with DHS restriction, that's all I can show them for now no temp EAD card for filling out I-9...??

Your SS card says Valid to work with DHS Authorization, and without the Temp EAD, EAD or GC (authorization) you cannot work legally.

The Temp EAD gives you Authorization to work until your I-94 expires, after that you have to wait for the EAD or GC.

Although....my husband's I-94 expires next month and his employer said he could continue to work since he got his drivers license. Makes no sense to me...

I didn't say you had to wait for the Temp EAD, only the real EAD. The Temp EAD's are only given at the POE. It's stamped on the back of the I-94, but once that expires, so does the Temp EAD and you are no longer authorized by DHS to work. In that case you have to file and wait for either the real EAD card or the GC.

Oh I see... thank you, got a bit worried over here. :blush: That means I will just show the employer my I-94 and the emplyment authorized stamp on the back and I should be good.

I could've easily carried on working after my temp stamp expired (agencys' didin't question the wording on my SS card), but decided it wasn't worth the risk - just in case I had to infopass to get my EAD and they asked if I'd been working illegally. Or if they ask me at my AOS interview. I don't really mind having a forced vacation anyway :)

My Temp EAD (POE Stamp) expired and I have had 3 weeks out of work but now I have my 1 Year EAD so I can go back to work. The quicker you file the AOS/EAD the quicker you will have it. I got married two weks after arriving and filed 11 days later (Just over 3 weeks).

04/20/2006 - file our I-129f.

09/14/2006 - US Embassy interview. Ask Lauren to marry me again, just to make sure. Says Yes. Phew!

10/02/2006 - Fly to New York, EAD at JFK, I'm in!!

10/14/2006 - Married! The perfect wedding day.

I wouldn't tell them, they will never know and the reality is that you cannot get in trouble so I wouldn't tell them squat. It is only for 60 -90 days anyway, and they probably wont check up on it.

If its a big company, they will check up on it. My husband was forced to quit his job at the end of the temp EAD. We didn't have the luxury of filing right after we were married so now he waits for the 1-year EAD card to get approved. The only good thing is they are keeping his job open for him for when he does get the 1-year card.
