Hi, I'm new here and hope to get some answers to my case. :)

I filed for I-751 the removal of conditions in January this year and still waiting for the 10 year green card. My green card got extended to one year (will expire on 11/3/2014), and I have the i-551 stamp on my passport which will expire on 1/15/2015.

I have also filed for N-400 naturalization on 8/19 because I've been a permanent resident through marriage for 3 years. I thought applying for citizenship might push the I-751 process faster. I just had my biometrics taken a few days ago.

So, I'd like to know what would be my status after my green card expires on 11/3? Both my I-751 and N-400 are still pending. Will I be out of status even I have the valid I-551 stamp on my passport?

Thanks for your time to read this!

The I-551 stamp trumps the I-751 NOA / extension letter. If you haven't heard anything by a month or so before your I-551 stamp expires then you should make an Infopass appointment and obtain another stamp.

Usually, filing an N-400 whilst the I-751 is pending will force USCIS to adjudicate the I-751 when they come to adjudicate the N-400.

That's strange. Isn't the I-551 just an extension of the conditional residency? Isn't the status still conditional - meaning martiage has to be proven to be bonifide? How can filing for naturalization force USCIS to remove condition? I'm asking genuinely as I know of someone in a similar position -extension. My impression of the matter is that the case is still not approved for full residency and can be denied at any point if not proven. Can you explain?

Hi made in heaven, I finally got the naturalization interview appointment letter in early January. That's almost 3.5 months after my biometrics were taken. The N-400 interview was scheduled for Feb 3. When I was all prepared and went to the interview that day, they said they couldn't find my file on the computer and wouldn't interview me that day! They apologized for the technical problem and sent me home, telling me to wait for another interview appointment letter... I waited for a few weeks and got another letter scheduling me for the interview on April 6.

So far no response from the I-751 application. I guess they will combine the 2 when I have the interview? And maybe asking more questions about my marital status.

USCIS never works as we expected. The only thing I can expect is to wait and wait and wait...

I wish you the best of luck!!

Hi coffeesnowman! How's your interview? Any great news? I had to do the biometrics again today because of a mistake on their part. Imagine my first biometrics was done on July 28, 2014 and just because I kept calling requesting for an update on my case as its taking forever, they realized they had a mistake when they sent me the biometrics letter with a wrong alien number.

Hi Made in Heaven, turned out my interview was canceled again. AGAIN! I received a letter just 3 days before my interview saying "This is to advice you that, due to unforeseen circumstances, we have had to cancel the previously scheduled interview on Monday, April 06, 2015 at 7:15am for the above applicant. We regret any inconvenience this may cause. We will advise you of any further action taken on this case, including any rescheduled interview information, under separate notice."

I received the same letter last time. The only difference is the date & time. I hope i won't receive it the 3rd time.

This is not acceptable. I'm not sure if I should make an Infopass appointment to ask them about it. They will probably give me the same answer: Just wait.

So now you'll have the biometrics appointment rescheduled?

Argh how much longer we have to wait...

I live in New York by the way. I heard they make more mistakes here...

i received a new letter for the biometric appointment late March so I had to do it again last Monday April 6. I asked them when I got there but they seem to just say I need to do it again since when I first did it, the alien number or green card number is incorrect (it was their fault by the way).

I suggest you call them and ask for a service request on (1) your i751 is outside processing time and (2) the status of the naturalization since they keep postponing the interview.

Honestly, I think in my case, by calling them many times for service request could have been the reason why they noticed something is wrong with my information. Every service request made, another officer gets to be assigned to respond on that request.

But who knows right, I just hope they haven't lost our papers or something. I was just told they are behind.

Thanks for your advice!

I called and asked for a service request last time right after they canceled my interview. 2 weeks later they sent me a letter saying I would receive another letter explaining why I got canceled. And then I got that letter "explaining" it was due to unforeseen circumstances that they had to reschedule me. Oh well...

But I get your point. The more we ask the more chances they would look into our cases. I'll just call a few more times like you suggested.

Thanks again and good luck to you!
