Name change without adoption, is it possible?

Hello fellow VJ members.

My sister was naturalized last year and I understand, her 13 yrs old girl is an automatic US citizen too (they just filed the N600) her question is, she and her husband want to change the child's last name to his (he doesn't want an adoption at this time maybe because he still has an issue with his adopted children from ex and that's another topic) but while he is not ready for adoption at this time, he is open to let the child use his last name. Is it possible?

Background: mother and biological father not married but father acknowledge the child on the birth cert and now the dad is no where to be found for years (he's from another Asian country).

Any asnwers will be greatly appreciated. Thank you very much.

The parents would need to petition the local court and ask for a name change for the child; their consent may be required, depending on their age and the relevant state law. Changing their name only will have no effect on the child's parentage or anything like that. The judge might need some convincing as to why this is in the best interests of the child.

Day 6 (1/9/18) Walk-in biometrics in Fort Worth, TX

Day 341 (12/10/18) Interview was scheduled for 1/14/19

Day 376 (1/14/19) Interview

Day 385 (1/23/19) Denied

Day 400 (2/7/19) Denial revoked; N-400 approved; oath ceremony set for 2/14/19

Day 407 (2/14/19) Oath ceremony in Dallas, TX

Name change is just a name change which any body can do that..that doesnt take away the parental rights of the biologicalparents which legal adoption does. We just started the legal.adoption process of my 2 kids
